Fight Detention of Mother and Child Seeking Safety

On Thursday, May 29th, 2025, E.M. and E.Q., a mother and child, were apprehended after appearing in person for an initial hearing before the San Antonio Immigration Court. Their attorney had previously helped them file for relief, and they hoped to schedule a final hearing for their cases to be heard in full.

Instead of a normal initial virtual hearing, the immigration judge entertained the government attorney's request to find E.M. and E.Q. failed to be present, but provided all the opportunity to arrive in court no later than the 1 pm docket. Attorney and clients traveled down immediately.

Although clients had previously filed an application for relief with the hope of setting a hearing to fully present the case, the government attorney requested that the judge dismiss the case. The judge granted that motion with no opportunity to substantively challenge the case. Worse still, after leaving the court with the judge's orders, ICE agents apprehended E.M. and E.Q. in the hallway and escorted them to white vans for continued detention.

Mother and child were both already heavily impacted by the events that led them to leave their home country in search of a safer existence. They were in the process of looking for mental health supports to help cope with the challenges of explaining past traumatic experiences. The apprehension put the mother into distress, and the child appeared in media footage attempting to calm her.

Your donations will help fund legal representation for E.M. and E.Q. Donations will be held in trust by The Meraz Firm, PLLC and any legal expenses will be reviewed by E.M. and E.Q. before authorizing any payment. Additional funds held in trust will be distributed to E.M. and E.Q.'s related needs, which currently have included travel to destination after release from immigration custody, and attention to health needs due to detention. Any funds in excess of legal expenses and related needs will be released to E.M. and E.Q. at the conclusion of representation.

El jueves 29 de mayo de 2025, E.M. y E.Q., madre e hijo, fueron detenidos tras comparecer en persona a una audiencia inicial ante el Tribunal de Inmigración de San Antonio. Su abogada ya los había asistido con la presentación de una solicitud de alivio migratorio, y estaban listos para programar una audiencia final en la que su caso pudiera ser escuchado en su totalidad.

En lugar de llevar a cabo una audiencia inicial virtual normal, la jueza de inmigración accedió a considerar la solicitud del abogado del gobierno de declarar que E.M. y E.Q. como ausentes por no comparecer en persona, aunque se les ofreció la oportunidad de llegar al tribunal a más tardar antes del comienzo del siguiente registro de causas a la 1:00 p.m. La abogada y los clientes se trasladaron de inmediato.

Aunque los clientes ya habían presentado una solicitud de alivio con la expectativa de programar una audiencia para exponer el caso de fondo, el abogado del gobierno pidió al juez que desestimara el caso. El juez concedió dicha solicitud sin ofrecer oportunidad de defender el caso de manera sustantiva. Aún más grave, tras salir del tribunal con la orden del juez, agentes de ICE detuvieron a E.M. y E.Q en el pasillo y los guiaron hacia unas camionetas blancas para su detención.

La madre y el hijo ya se encontraban profundamente afectados por los hechos que los obligaron a abandonar su país de origen en busca de una vida más segura. Se encontraban en proceso de buscar apoyo en salud mental para sobrellevar las dificultades de relatar experiencias traumáticas del pasado. La detención causó una crisis emocional en la madre, y el hijo fue captado por medios intentando calmarla.
