As most of you know, my brother Kris was in a horrific car accident about 16 years ago. At the time he was freshly divorced and his oldest 2 children were 2 and 3. Before that time, he struggled with problems that led to the end of his marriage. His ex wife (again, most of you know) had an attorney prepare the settlement agreement/divorce decree. She promised my dad and my brother this was only a scare tactic to save her marriage so my brother signed the paper not realizing he was agreeing to a final divorce agreement. In this agreement, among many absolute one sided issues included my brothers responsibility to pay for 1/2 of the kids college. Not her to pay, just him.
fast forward to current day. He was on disability many years then decided after being remarried and having another child it was beneficial to go back to work. Financially and mentally it was good for him. He’s in a good place now although hourly income is still not what it was prior to the wreck. That being said he has not missed a child support payment, even when in a coma, my parents and uncles paid. He has worked his entire life to support his kids while she has not. She filed contempt on him to pay for 1/2 of his daughters first semester, then added 15 years of medical expenses and her attorney fees on top. He offered to pay $600 per month as that is all his budget will afford. That wasn’t enough. Now she wants $8,000 or he goes to jail. In addition, over $1,000 per month. My brother, with a brain injury and hears crickets everyday of his life all day because of it will be sitting in Dawson County Jail because of her vindictive soul. I paid $2,500 for an attorney to represent him in contempt and we were grossly outlawyered to the point we didn’t know there was an in person court hearing until 90 min before it started. At a sad whits end.
Those who know, know. He’s lived a quality life balancing even driving to Alabama to pick his kids up every other weekend. We know you reap what you sew but hoping for a miracle that keeps my brother out of jail and able to support his family. thank you!
