The advocacy group ESPLERP is leading legal challenges in state courts to dismantle systemic abuses that criminalize vulnerable individuals, strip away personal autonomy, and violate constitutional protections.

Stopping Municipal Harassment & Invalidating PC § 647(b)

At the center of this fundraising push is active litigation challenging local enforcement tactics and outdated criminal statutes that infringe on basic civil rights.

• Fabricated Allegations Under the Guise of Protection: Municipalities—such as Tracy (Chapter 4.20.210) and Santa Rosa (§ 20-49.120)—are using manipulated local codes alongside California Penal Code § 647(b) and § 318 to shut down Asian Massage Businesses. Law enforcement officers use these provisions to fabricate allegations and generate arrest records without citations or corroborating evidence, falsely claiming to fight human trafficking.

• Constitutional Rights Violations: These undercover raids and arbitrary property shutdowns violate federal and state Due Process, Civil Rights, and California's constitutional Right to Privacy.

• Active Legal Challenge: ESPLERP has filed a lawsuit against the City of Tracy in San Joaquin County Superior Court to invalidate these 19th-century laws (PC § 647 dates back to 1872) and protect the right of individuals to determine their consensual personal interactions free from government intrusion.

Ongoing Battle: Blocking AB 379 and the Deportation Pipeline

• Reviving Discriminatory Loitering Laws: AB 379 functions as a new version of repealed anti-loitering laws that unfairly target Black and Brown Californians, trans women, immigrants, youth survivors, and sex workers based on mere suspicion.

• Feeding Mass Deportations: If signed into law, AB 379 will empower federal agents to arrest vulnerable individuals and funnel them into brutal detention centers abroad.
