2025 Session: Florida Kratom Consumer Protection Act

In the 2025 legislative session, HB 1489, titled the “Florida Kratom Consumer Protection Act,” aims to regulate the manufacturing, distribution, and sale of kratom products. The bill prohibits processors from producing or selling kratom products that do not meet specified requirements. It establishes permitting, registration, and certification requirements for kratom processors, with certain exceptions. The bill also outlines the responsibilities and liabilities of processors, specifies standards for laboratories certifying kratom products, and grants the Department of Agriculture and Consumer Services (DACS) authority to conduct third-party testing and enforce regulations, including imposing administrative fines. Additionally, the bill provides for an appropriation to support its implementation.
