My 19 month old daughter Madeline was abducted by her mother/My ex-partner to Brazil.

Madeline was born in Calgary Alberta, Canada; April 2017. At the time her mother and I shared a residence. A few months after her birth our relationship started to deteriorate due to safety concerns of Madeline
and the mental health of her mother. Family services and police were involved multiple times due to actions taken by her mother. I provided financial support for many months before I found it in the best
interest to move Madeline to a safer household. Her mother was still given time with Madeline. All I wanted was for her to get the help she needed and to stop the drug abuse, so Madeline could have both parents in the picture.

In June 2018 I decided to go to court for Madeline’s custody as no improvements were made by her mother. Due to her current financial state I thought it best that Madeline not leave Canada as there was
great fear that her mother would take her to Brazil with her family and never return. There were multiple occasions in the past that support this as the mother threatened that they'd be better off there, and the grandmother also stated in May 2017 that she will take Madeline back to Brazil and I would never see them again.

After the first court date the judged ruled in an interim without prejudice order that Madeline is to spend 4 days with her mother and 3 days with myself while further court action is taken. It was also added that Madeline will not leave Canada with either parent until a travel order is obtained from the courts.

As uncomfortable with those days as I was, I did agree and followed the order perfectly. Her mother and I both took a parenting after separation course and continued to go to court. In the most recent court it was finally decided that the child family service reports would be allowed as proof/evidence in the upcoming decision of custody for Madeline. Court was set for Judicial Dispute Resolution in January and a final trial date set for mid February.

Unfortunately on October 19 2018 Madeline returned to her mother custody as per the court order... On October 22 I had emailed her verifying the time of pick up for myself for the following day. That was the day the world had turned upside down for me. Madeline’s mother responded and stated that she went without my approval to the government in Brazil and obtained a Brazilian passport for Madeline. Doing so allowed her to travel without my knowledge. Madeline was taken from me without permission or notice, and against the court order.

I immediately called the police, and my lawyer to begin the process as this was parental abduction. The very thing I feared most had happened and I was told all I can do is fill out paperwork and wait. That all being said, I’ve done all I can currently do and still undergoing the process and pain of trying to recover my baby girl.

Any donations would be going towards legal fees for retaining counsel in Brazil, paying for the extra fees associated with filing with the Hague Convention, extra fees for my legal counsel in Canada, and travel to and from Brazil.
