My sister's daughter Evelyn, who I had custody of for the first two years of her life has been removed from Texas and the care of my sister by my Aunt Amy and Stacy with the help of a Denton County Attorney Ad Litem. I will not stop until everything and everyone is exposed. 

After Evelyn was removed from my custody in 2018, she was moved to Texas under a new TEMPORARY guardianship with my Aunt Amy Mahrt. Allyson and Leslie relocated to Texas to be close to Evelyn. Evelyn lived with Allyson and Leslie from 2018 to 2021. After the passing of Evelyn's Father, Allyson struggled with her addiction and relapsed. Allyson decided on her own to get treatment. While doing so, Evelyn moved with Amy. During the year back at Amy's house, 2 DCFS Investigations were completed against her son and husband regarding sexual abuse allegations, and Evelyn's claims were said to be unfounded. This enraged my aunt Amy.

At this point, Allyson had been sober for eight months and was doing exactly what Amy had asked to get custody of her daughter back. Allyson currently has two jobs and can prove her sobriety. As soon as Ally was close to regaining custody of Evelyn, Amy went to the Denton Probate court and relinquished the guardianship of Evelyn on 5/24/2022. Amy gave up on her, potentially leaving Evelyn to be a ward of the State of Texas, knowing full well that Allyson wanted her daughter back in her custody. A guardian ad litem was appointed. Then, without speaking with Allyson or any other family members, it was decided what the best thing for Evelyn was. They moved her to North Carolina with her great aunts to live on an isolated farm and be raised by two women who have never raised children.

On June 21, 2022 Allyson Kelly filed a petition with the court to " to terminate the temporary guardianship of Evelyn Jacob and relieve Amy Mahrt of all duties as guardian. The guardianship is no longer necessary and as her mother and only living parent I wish to resume my parental rights and full custody. I am willing to provide the courts with any and all proof/documentation necessary to complete the termination of guardianship over Evelyn Jacob.:"

On 6/23/2022 a motion to move her out of state was was filed.

on 6/27/2022 the motion was odered.

Without the Attorney/Guardian Ad Litem doing any due diligence to determine where the mother stands with her sobriety or reaching out to ANY family members. Especially myself, who, as the prior guardian, has an emotional connection and vested interest in the child in question.

Amy told Evelyn that she was going on a summer trip to my Aunt Stacy's farm in North Carolina at the end of June 2022. She was left there by Amy and never went back home to her Mom. She did not get to take any of her clothes, toys, or belongings. She is distraught telling my sister to "Get the plane ready and bring me home."

Allyson went from being a full-time mother to being allowed three phone calls weekly and supervised visitation once a month. This requires Allyson to give ten days notice, take time off work, pay for flights, accommodations and a supervisor to see her. Making it financially impossible for her to see her daughter.

My aunt will not let me, my kids or my parents have face time with Evelyn.

Evelyn is having emotional outbursts because she misses her mom and does not want to live there. Stacy testified in court that Evelyn was so upset she couldn't calm her down, and was considering taking her to the emergency room to be sedated. She is 6. 

Between my Mother, Father, Sister and I, we have spent over 40k in attorneys fees and will not give up until Evelyn is reunited with her mother.

Texas Probate estate code chapter 1202 Sec. 1202.001. TERM OF GUARDIAN OR GUARDIANSHIP. (d) A request for an order under this section may be made by informal letter to the court. A person who knowingly interferes with the transmission of the request to the court may be adjudged guilty of contempt of court.
