Creating a Trust for Asher

Hello, my name is Kate Awada. Back in 2015 I met a remarkable person, Allie Janisch, whose friendship became a cherished part of my life. Today, I am reaching out with a heavy heart, as Allie is no longer with us, leaving behind her son, Asher, who faces the challenges of autism and Type 1 Diabetes.

Allie's absence has created a profound void, and it's our mission to ensure that her son Asher continues to receive the love and support he deserves. To this end, we are setting up a Special Needs Trust (SNT) for Asher, and I am joined in this effort by a dedicated team: Kristin Dittus, an estate attorney; Ami, Asher's godmother; and Norine another family-like friend.

The SNT is designed to provide for Asher's unique needs while maintaining his eligibility for vital government benefits like Medicaid or Supplemental Security Income (SSI). Here are the important features of this trust:

Preservation of Government Benefits: The SNT ensures that its assets are not considered Asher's, preserving his eligibility for government assistance.

Controlled Distributions: A trustworthy trustee will manage the trust's funds, ensuring they are used for Asher's essential needs, including his educational, healthcare, and personal care expenses, particularly for his diabetes management.

Investment for Growth: The trust will be invested strategically to ensure growth and sustainability, providing support for Asher throughout his life.

Flexibility and Protection: Customized to Asher's specific needs, the trust offers protection from creditors and ensures responsible fund management over his lifetime.

Kristin Dittus, an experienced estate attorney, is guiding us in setting up the trust effectively. Ami, Asher's godmother, and Norine are also integral to this initiative, providing support and information to anyone who wishes to learn more or contribute.
