THE FACTS:

This 40B Appeal would require the State to look at the very serious disruption and adverse changes to the quality of life and property values of your neighborhood, and the extremely serious public safety issues with the accessing roadways that this 40B would cause. The State must be allowed to see why this is the wrong place for such an overdevelopment, and why just “Rubber-Stamping” an approval for this 40B Project could potentially put peoples’ quality of life and lives at risk.

I am not an abutter to the Rice Pond Village 40B Project. Because of this, the opposition is demanding that our Appeal be dismissed immediately.

The following DIRECT ABUTTERS, whose property directly touches the 40B Project, need to SIGN ON as Plaintiffs: Rice Road and Jackie Drive residents.

Why? For example, a four-story building on a hill overlooking your house’s windows and backyard is a breach of your privacy. This is one of the strong arguments that Direct Abutters have used to win before.

The remaining abutters within 300 feet of the 40B Project are asked to SIGN ON as Plaintiffs also. This adds strength to this 40B Appeal.

Will anyone who signs on as a Plaintiff be sued? Anyone can be sued…but in this case, it would be dismissed. I’ve taken Millbury to court 3 times, and I’ve never been sued by the Town or the Developers.

As a Plaintiff would you have to appear in court? No. However, a large group of people in the courtroom adds strength to the 40B Appeal.If I SIGN ON as a Plaintiff, will I be responsible for any outstanding Lawyer’s bills? No.
