ALASKA RAILROAD UNLAWFULLY SEIZING PRIVATE LAND

The Alaska Railroad is attempting to strip Alaskans of access to public lands and private property rights from Seward to Fairbanks, affecting all Alaskans and tourists seeking access.
The Alaska Railroad Corporation is aggressively suing Alaskans to absorb their land and further expanding track easement over federal, state, and private land into ownership exclusively for restricted use.
Alaskans MUST fight back.
Decades-old statutes prohibit the railroad from doing this. But, “here we go!” Surprised? Don’t be. It’s been in the works for a while behind your back. This attack on the rights of all of us gives the railroad the ability to limit access for outdoor enthusiasts and dictatorial control over utility access and pricing that will appear on your utility bill in the future.
“Exclusive use” rights claimed by the railroad in the lawsuit allow it to fence off the entire 200’ -foot- wide track easement and to bar all private and
public uses, unless the railroad agrees to the use and is paid. This is a tax on all. The railroad decides the amount.
The Railroad is also seeking a 500’-wide ROW for the new rail line to Canada. An “exclusive use” ROW there will allow the railroad to control access to public lands on both sides of the route...effectively dividing the state. Residents in South Anchorage recently challenged the railroad’s “exclusive use”. The railroad sued them and intends to sue others who object. If the lawsuit is won by the railroad because no one defends this assault on the rights of Alaskans we will all suffer from this new and uncontrolled taxing authority.
