The Los Osos Sustainability Group (LOSG) is launching this fundraiser as it is researching the possibility of a lawsuit against the County, and possibly the developers, because of the approval of the Anastasi Tentative Track Map 1646/Coastal Development Permit. This subdivision started its approval almost 35 years ago and is the largest subdivision to hit Los Osos for about that long. Their Permit had two conditions and neither were met.

Condition #1 stated: “The Applicant shall not file the final map unless and until. . . the sewer system. . .is available for the project to connect to.” As we all know, the sewer system is not available to connect to, because Condition 6 of the Coastal Commission’s CDP for the LOWWP prohibits this.

Condition #2 stated: “Prior to filing the final map, the Applicant will be required to demonstrate an adequate water supply. . .” The County’s current policies place a level 3 severity on the Los Osos Water Basin. This means the basin is in overdraft. The State’s Department of Water Resources places the LOWB in extreme overdraft and the Coastal Commission stated in its 4/19/22 letter to the County that there is likely not enough water for the current population. Considering these, there is definitely not adequate water for approving this project.

In approving the finalization of this map, the County is assessing that the sewer is available for hookups and adequate water exists for more development. The LOSG opposes these assessments and feels they create a dangerous precedent. If the lawsuit proceeds it will cost in the neighborhood of $35,000. The LOSG will donate $5,000 towards this goal, but this has to be a community effort. Go Fund Me will hold all donations until the the goal is met or the deadline passes. Filing will have to take place before the end of the month. If the lawsuit does not move forward, for one reason or another, ALL donations will be returned.
