
2nd-Parent Adoption legal fees for LGBTQ Families

LGBTQ+ families are not all treated as equal under the law. Rights and protections vary state by state and all too often the status of our rights is dependant on who is seated in office or authority.
Marriage Equality laws were changed after the landmark supreme court case, Obergefell v Hodges. This case ruled that the fundamental right to marry is guaranteed to same-sex couples by both the Due Process Clause and the Equal Protection Clause of the 14th amendment. This allowed for marriage rights, but it did not guarantee parentage protections.
Parentage was presumed but NOT guaranteed to be protected. The two leading legal advocacy groups for the LGBTQ+ community, Lambda Legal and the National Center for Lesbian Rights both recommend LGBTQ+ families obtain a second-parent adoption to protect their families.
After the death of Supreme Court Justice, Ruth Bader Gingsburg, the Trump administration rushed the appointment and confirmation of Amy Coney Barrett thus putting LGBTQ+ rights and protections at risk. On November 4th, the supreme court will hear its first case involving LGBTQ+ rights and parentage. Many LGBTQ+ families are expediting the process for both marriage and adoption as the future outlook is unknown and bleak.
Chicagoland Rainbow Families is working with Rosemary Mulryan who served as co-council on the court case that changed the adoption laws in Illinois to include LGBTQ+ couples. While we are grateful there are methods available to protect our families, these do come at a financial burden to many families. In order to make this accessible to all of our families, we are raising funds to offer mini-grants to offset a portion of these expenses.
