I am working with a young mother who has had her newborn baby taken from her by the child’s father and his family. This sweet baby is less then a week old and needs to be with his mother.
The father and his family have given multiple baseless reasons why they are withholding the child. None of which have any factual evidence to back up. The one time they have agreed to let her see him she had to beg to be able to hold him. Dani desperately wants to be bonding with her son and breastfeeding him at this critical time.
The police have no ability to mediate the situation between two legal parents. There was an hearing set to request emergency temporary custody but because the child is not in “danger” with the father the courts would not order the father to return him. Although the commissioner did ask him too she could not legally order it. A hearing was set for the 7th for a judge to start the process of determining custody. Both parents are fit to be in this child’s life. To love and care for him as all children deserve.
Dani, the mother is smart, articulate, caring and a strong mother. She has no drug issues, prior abuse or neglect cases, is a hard worker, pays her bills and I have every confidence that the court will see this and she will be awarded custody. I am proud and happy to vouch for Dani and her son to be reunited.
We are pursuing every opportunity for pro-bono legal representation but have been striking out due to a high case load for local attorneys who do this kind of thing. This money will be used towards a legal retainer so that Dani has much needed legal representation. As the first court date is set for May 7th time is of the essence.
I can’t think of much worse then being separated from any of my children let alone my newborn. If you are able to help financially please do and I am happy to answer any questions the best I can.
