CHINATOWN A STEP CLOSER TO SAVING A SMALL BUSINESS FROM DISPLACEMENT

CPA announced today that Mr. Yan Chi Chen expects to settle the commercial eviction case against him and A Salon, which operates in the heart of Boston Chinatown’s row house district. On the eve of trial, the parties agreed to ask for an additional 30 days from the court to work out an agreement. Mr. Chen will continue to operate his salon serving the community.

CPA and other members of the Chinatown Stabilization Campaign thank all who supported Mr. Chen in his legal defense. CPA Executive Director Karen Chen said, “We want to thank Mayor Walsh and his staff, Housing Chief Sheila Dillon, Councilor Ed Flynn, and our many allied organizations who supported Mr. Chen.”

Ms. Chen also added, “We want to extend a very special thanks to attorney Frank Flynn and the Flynn Law Group for working very hard to get a commercial landlord to agree to dismiss the commercial eviction case.”

Mr. Yan Chi Chen runs an affordably-priced hair salon serving a working-class clientele out of 106 Tyler Street, a row house with four apartments above a ground floor salon in Chinatown. Mr. Chen has a 10-year lease and is on the 7th year. In 2017, new owners Haiying Ji and Xinsheng Zhu of Weston bought the building, well above market price, and used the residential units as short-term rentals. Mr. Chen received an eviction notice in December 2018 asking him to leave immediately and pay $68,312.10 for the remaining three years on the lease. Although the landlord alleged that Mr. Chen failed to produce an insurance certificate on demand, Mr. Chen had insurance the entire time. Mr. Chen had initially provided different documentation due to language barriers and despite producing the correct document shortly after, the landlord took him to court anyway. Today, the landlord agreed not to go forward with the case if Mr. Chen continues to buy insurance and produce the insurance certificate as needed.

Expressing gratitude and appreciation to a group of supporters who showed up in court, Mr. Chen said: “I am relieved that trial is avoided. I have not been able to sleep or eat since I received the court papers. It was hard for me to even celebrate Chinese New Year. Thank you to everyone in the community for coming to court and my salon on Valentine's Day, and for donating to my legal fees. I am happy that I will be able to continue to operate A Salon. Come cut your hair there!”

Stayed tuned for a full statement as the parties finalize the agreement. Preserving Chinatown’s historic row houses is an important part of Chinatown’s future.

The Chinatown Stabilization Campaign, which seeks to sustain residents and small businesses in the neighborhood, helps the people who built and kept the community alive over the years to remain by growing and preserving the affordable housing stock, seeking community control of public land and removing properties from the speculative market.
