Hi everyone! My name is Wess, and this is my son, Jace.

Jace is your average 4 year old. His favorite color is blue, he loves the Beatles, and he enjoys throwing his toys EVERYWHERE!

The Backstory

In February, my wife walked out to find greener pastures and took Jace with her.

Over the following months, she filed for divorce and repeatedly put Jace into detrimental and dangerous situations.

She took him from our house to a hotel, to an apartment that she was evicted from, and then to a house with some of her friends.

She had also let him stay in dangerous places with men she had only known a few days. I was left with a massive amount of debt, so hiring an attorney wasn't possible.

I attempted to get legal aid, but I didn't qualify due to my income level...which was too high for help, but not high enough to pay the bills she left behind or hire legal representation.

I had originally attempted to represent myself legally, but then few weeks ago, she agreed to give me sole custody of Jace because she agreed that I was the more stable parent by signing a Mediated Settlement Agreement.

She signed the MSA on September 19th.

A week later, she dismissed the divorce.

Then on October 1st, she brought Jace to my apartment to live with me.

Without a court order, I am unable to request the child support that she agreed to pay. If you're a working parent, you know how difficult this situation is.

Well, now what?

In order to ensure Jace's well-being, I have realized that I must hire an attorney to make sure that the divorce is handled correctly.

The problem: the average retainer for a divorce attorney in my area is around $9,000 to handle custody.

They will not even consider a case without a cash payment up front. I’ve exhausted every other option that I could find, and I hate asking for help, but my son comes first.

So here I am. Every dollar is one step closer to my goal. I’m not asking for large donations. Any amount will help us cover the expenses to make sure that Jace can stay in a safe home and have a happy, stable life.

If you aren’t able to donate, please consider posting this on your Facebook or other social media account so that I can reach my goal as quickly as possible and make sure that my son can be taken care of.

Thank you for your time.

Hi everyone! Just wanted to give an update on everything since it has been a while.

The good news...we were able to hire the attorney and get the process moving a little while back. Mediation is done, and the main custody agreement has been settled...and it's good!

The bad news...we're already over the initial retainer, and we haven't even been to court yet to sort out debts and child support (which should have been completed during mediation, but there were a few factors that stalled us.

To make a long story short, we're having to fight to keep a person with a criminal history away from Jace. The custody part wasn't even argued, his mom agreed to give me primary custody with no hesitation, but as for her friend...well, she's fighting to be able to keep him where he can be near Jace.

It seems that Jace's safety would come first, right?

So this has been drawn out. We also have to settle debts and child support. Apparently none of the aftermath is that important to everyone.

Here's why it matters:

With the large amount of debt left, I've already had to default on 5 lines of credit thanks to having to prioritize paying rent, utilities, a big car note, and buying fuel and groceries. There's not a lot of wiggle room in the budget.

Refinancing the car to get a lower monthly rate isn't an option because of the credit defaults.

Also, part of the custody agreement involves my ability to move. She requested that I stay in the area. I have no plans to move, but I have two older children outside of the restricted area, and all of my family live out of state...so I literally have NO backup in the event of an emergency.

Not winning this battle puts Jace's well-being on the line, since part of taking care of him is making sure that I can pay all of the bills. I can cover the critical bills, but anything else...not a chance right now.

The major credit hit is fixable, but not without making sure that we can sustain ourselves. Everything we can cut out has been cut out.

We don't have any extra to keep throwing into this, unfortunately. To put it in perspective, the attorney fees for mediation alone were $1,200. That was for 3 hours.

Otherwise, we're doing quite well, but we could still use any help we can get so that we can knock this out and move forward!

Thank you to all of you who have donated or shared this...even sharing this helps!

Please keep sharing!

Hi everyone! Just a quick update...I figured out how to add offline donations to our total. A lot of people have been kind enough to pitch in outside of the GFM page, so that has been reported in the total raised.

Thank you all!

Wow! 500 shares...$900 raised so far...thank you all so much!

Just a quick update to say that we're still working on getting things going. The attorney has been hired (thanks to some friends that are helping outside the scope of this fundraiser), and we are working to get everything handled...although there's still a good bit to go. The initial retainer was $2,200, but the total retainer was set at $5,000. When you factor in the costs of the fundraiser plus account for any amounts over the retainer, it adds up fast.

Specifically, the goal of this is to raise enough to cover the total legal costs. I'm working on saving as much as I can to put towards this. We are needing to make sure 1) we can hit the $5,000 retainer and cover any overages that may happen and 2) pay back the personal loans that are helping to get this going as well.

Anyway...a huge THANK YOU to everyone who has donated or shared this...we need all the shares we can get!
