I was recently refused an extension on my Visa to remain in the State of Israel while awaiting my Aliyah (citizenship) application.

My current Visa allows me to remain in the country until December 11, 2018 with my wife, Tamar, an Israeli Citizen.

This fund is for the legal expenses and other costs of keeping me in Israel with my wife and family.

I have been waiting on a response to my Aliyah (Citizenship) application Since May 15, 2018.

My story was recently covered into Tablet Magazine, an American Jewish  publication.

The Trials of David Ben Moshe

I am a convert to Orthodox Judaism, and came to Israel to study at the Pardes Institute of Jewish Studies in the Summer of 2017.

After the summer program I received a grant from MASA and won a Social Justice Fellowship to continue my Torah studies for the 2017-2018 academic year.

I won the Social Justice Fellowship largely due to my activism in the community.  I speak about my experience in Federal Prison. Where while serving a 30 month sentence, I found Judaism and changed my life. I was then released early for good behavior. Additionally since my release I have done multiple community service projects with my Synagogue and the Baltimore Police Department.

During my time studying, I also met my future wife, Tamar. Her family welcomed me with open arms and we got engaged and then married.

As my studies concluded in May of 2017 I completed my application of Aliyah. While I have not gotten a response yet I have been:

-Threatened with deportation

Please read the above article  for more information on this.

Now that the Ministry of the Interior has refused to grant me an extension on my Visa I have 3 options.

1. Return to America, leaving behind my Wife.

2. Remain in the Israel illegally, which can be used against my Aliyah application.

3. File a petition and go to court against the State of Israel.

I am choosing to go to court.

A the end of last week my file was found! One of the lawyers located it with a high level ministry official.

The official says the file has been marked as urgent and I should expect an answer in a "few days".

In addition this official is willing to go on the record that I don't have to leave the country. This is enough to satisfy my lawyers and we will not file a petition.

Instead we can save our energy for the possible appeal that we will need if I am denied. They have still not given a hint as to weather my application with be confirmed, or denied.

Aliyah Update:
This morning I spent another 3 hours in Misrad Hapnim (The Ministry of the Interior) with my wife, and a lawyer.

Despite showing the relevant statutes as to why I was legally eligible for a Visa extension I was AGAIN DENIED a Visa or any other documents.

The lawyer then presented a letter from the law firm immediately demanding that I be granted a Visa to remain in the country.

Afterwards we met with the lawyer again who is now going back to working on the court petition. She will also return to the Ministry on Sunday morning to follow up regarding the letter.

However there was a BIG win we finally managed to change Tamar's status with the government to "Married".

There was a interesting moment in the Family
Reunification office where they AGAIN told us we were in the wrong place, and needed to go somewhere else. The woman who was helping us said she needed to speak to the manager and wasn't sure if she was in yet.

So we told her than manger is definitely in, we just left her office and our lawyer is still there.

When we returned the manager (who I have gotten to know very well over the last year or so) fixed the problem and personally updated her status
