It is with a heavy heart that I am lauching this Go Fund Me campaign on behalf of my family. Back in March of 2015, I used my VA loan to purchase what my family thought was our dream home. Within three months of moving into the home, we noticed the rear concrete patio starting to crack, and the rear French doors by the basement walkout started to pull away from the house. The basement floor by the French doors started cracking and sinking in, and the basement back wall started to bow out at the bottom.
As the problems progressed, we called several trade companies (concrete businesses, landscape businesses, foundation companies and structural engineers) out to assess the problem. Several of the companies said they had come to this home before in the past and refused to work on it, due to known ground movement. As luck would have it, we located one of the home's previous owners who disclosed to us that the home is located on a landslide and has a void underneath it. None of this these things were visible to our home inspector due to the freshly poured concrete patio and stoop by the basement walkout and the void underneath the home was concealed.
The previous owners informed us that they sold the home to our seller for $25,000 due to the repairs costing in excess of $200,000. The seller of the home did not disclose any of these issues to us. The previous owners have given us documentation showing that our seller was fully aware of all of the existing problems with the home when our seller purchased the home from them. We purchased the home for $238,000; as you can see, the seller made a large profit.
We are in legal proceedings now in order to nullify the sale contract of this home. In trying to recover our money from the seller, we have incurred large ongoing monthly legal expenses in excess of $7,000-$9,000 a month. The amount we're asking for is what we anticipate the entire cost of legal proceedings could be. We have maxed out our credit cards and have taken a number of loans just to keep up with our legal fees so far. We have asked the VA to get involved in this matter but they refuse on the grounds that they simply issue loans. Walking away from this home is not a option; in doing so, I would forfeit my ability to ever use a VA loan again. Walking away would also mean both my wife and I would be walking away from our jobs, because we need good credit to keep them. Anything that you are able to give is very much appreciated.
Please help us see that justice is served! The realtor involved in litigation is also an elected city official in one of the surrounding counties. Can you imagine someone that you trust in your community that is willing to do anything for the sake of profits? ?
