We are Kyle and Leah Broshears of Seymour, IN.  We both grew up on small farms in Jackson County.  Life on the farm taught us at an early age that hard work and sacrifice are the life tools of eventual success.  By working with livestock, we learned what true responsibility really meant.  It is a 7 day a week commitment that comes with the lifelong reward of helping to feed our nation.  

These characteristics and experiences were something we wanted to instill in our children.  So in 2014, we applied for a permit to build a swine finishing barn on our family’s farm.  We appeared before the Jackson County Plan Commission in September and received a unanimous favorable recommendation.  We then went on to the Board of Zoning Appeals in October, where we also received unanimous approval. 

We are now asking for your help to defend our farm against a group of disgruntled homeowners who are bringing litigation against us.  If lawsuits against agriculture like this one are allowed to succeed, then the end result will be no new growth. What option will be left to meet the needs of our growing nation?  Import from countries without the high level of food safety standards we depend on here? 

Please help us keep our nation’s food production right here on American family farms.  Take a stand with us as we defend our farm and fight for the right of all citizens to enjoy an American produced food supply.

Great News!
Another victory for Agriculture.
We would like to update everyone on the progress towards building our swine finishing barn.
We received our permit through IDEM in July of 2017.
However, we quickly found out that permit was being challenged. Through more court hearings, and depositions, it is finally finished. We also came out victorious on this appeal.
We hope this is our last hurdle and optimistic to begin construction on our barn this spring.
We would like to thank every for your kind words and continued support in saving our bacon.

The decision from the judicial review including the findings of fact, conclusions of law, and judgment of petitioners and intervenors against us, the Broshears and our approved plans for a swine confined feeding operation came today. The judge sided completely with us and denied all the oppositions’ claims.
This conclusion is one we have been eagerly anticipating since the final briefs were submitted approximately 30 days ago. If you recall, our plans for the swine finishing facility were approved in October of 2014.
We would like to thank everyone from the agriculture industry, as well as our friends and family who have continued to support us. This has been a long, time consuming battle but one that is worth fighting.

We just wanted to update everyone that we have completed our final court hearings for our swine finishing barn. The lawyers will have approximately 30 days to each file their briefs and then the judge will have around 30 days to make his decision.
We would like to thank everyone for their continued support and kind words.

We are excited to inform all of you that we have a ruling in our case. While it does not put an immediate end to the lawsuit, it does prove by court of law that activists and imagined grievances have no foothold in reality.

The court has ruled that our motion to challenge all the petitioners on their standing was successful on approximately half of those individuals. Anyone further than a 1/4 mile away (and there were many) does not have sufficient standing to challenge the BZA approval.

This motion was carried out in excellent form by attorney's Jim Federoff and Jason Kuchmay from the law office of Carson, Boxberger, and Associates in Ft. Wayne, IN. Not only did the court rely upon their findings of fact in its decision, they also were able to counter every single appraisal that was offered in opposition. We had an expert market analysis done by Joel Buzzard which looked at local home sales data from the last 10 years in Jackson County that showed no impact on property value whatsoever. The appraisals offered by our opposition however had zero actual home sales to compare. For that reason, the court relied on our study to base its opinion. A big thanks to Joel, Jim, and Jason for having the foresight to know we needed that information.

We can not thank each of you enough for all the prayers and well wishes that have come our way throughout this process. We will not give up no matter how long this takes. We can not and will not accept that the dream of coming back to the farm for young people is over simply because those who know nothing of our livelihood wish to destroy American agriculture.

Please continue to take a stand for agriculture in your own communities and we will continue to fight the good fight here in ours. Bad things happen when good people do nothing. You have all actively chosen to be "good people" by standing up for ag. Use every opportunity to speak the truth about agriculture. You never know when your few good words of truth are just the leadership example that a "fence sitter" needs to make a better choice.
