Save MMJ Safe Access in WA State
Washington State's very progressive MMJ laws enabled patients to safely use their medicine under the guise they had admissible defense to do so, as the FDA says marijuana is still a Schedule 1 drug.
In the wake of:
patient and doctor registries,
restrictions on autonomous processing (some with good reason),
the refusal to drop the 37% excise tax,
closure of collective safe access points known as "dispensaries,"
and extreme lack of not just diverse but necessary products for patients
Washington State is no longer safer, or more progressive,
than any other state that has an MMJ program.
Some feel, and it is my opinion, Washington State relinquished the closest model this nation had for "real legalization."
What hurts more is that the model that was given up was not given up for the better of the patients it once took care of.
It was given up for a variety of reasons, none of which benefit anyone that
consumes (medical or recreational) marijuana.
RCW 69.51A showed that marijuana is a plant that needs a community.
By asking patients to share medicine, it inherently forced them together to figure out
a system to provide the best medicine to everyone.
It became so much more than that.
Yet, I personally watched the head of the Washington State Liquor and Cannabis Board
grin and shake her head dismissively at a patient who, a bit frantically, made some very good points at a public forum for comment on the changing MMJ laws.
The decriminalization of marijuana possession and distribution of licenses to sell
a schedule 1 drug has shattered, and is actively disregarding, the community Washington State patients built over 15 years.
Under 502, the weed you buy from Washington State will never be promoted as something
that could improve your health.
It's advertised as something that's "out of this world."
The fight isn't over.
Talk to the peers in your own community about what is going on in Washington State.
Tell your friends in other states and countries.

A quick update on what's going on:
Yesterday, the northwest cannabis market closed its doors under the pressure of the city and county.
With six months left for 69.51A (if you're lucky enough to have a valid authorization that doesn't violate your fifth amendment rights in Washington State at the moment), the beginning of 2016 is the time to throw a little extra wood in the fire.
Columbia Holistcs vs the City of Seattle has been awaiting a ruling since December 4 2015. No word has been given on when this ruling will come out.
South King Holistic vs the City of Kent continues Febuary 22 2016.
SKH's legal council will be defending them passionately. It's an amazing thing to see, and we will give you more info about attending when it becomes available.

The White center sheriffs office shows you what they really think about medical marijuana and the patients that need that medication. Their smug demeanor said it all. They do not give a care about anything but bringing the money into their system. This is exactly why sb5052 needs to be repealed and the lottery system needs to stop. We need to allow dispensaries to operate as a business, and have testing of the medication but let the people choose where they get their medication. The state keeps saying how they need to regulate so people do not get sick from bad weed BUT WHY DO THEY NOT SHOW US WHO HAS GOTTEN ILL FROM CANNABIS? Because they do not have anyone who has gotten ill. The state liquor board needs to stick to booze and regulate it to stop all the death and illnesses that come with the use of ETOH and leave cannabis alone. All that is happening is people are going to go to the black market and that is what the sheriffs office wants, that is what keeps the police in business (being able to arrest people for cannabis)The luck of the draw (lottery)does not make good medication or good sense. Sometimes a patient needs to try up to 5 or 6 strains before they get the right one to help their condition, That is why we at Macgraws give out samples of different strains until our clients find one that helps them with their condition. As a retired registered nurse I can attest to the good medical marijuana has done for many people. I will talk to anyone who needs to educate themselves, call me at my dispensary and I will do what I can to help you find the correct strain for your condition free of charge. I agree there are some dispensaries that need to go, but any business that is not kept clean and have a smoke free environment needs to go. Also when a dispensaries is not run as a collective it needs to go. So we need the health department to work with dispensaries and not the liquor control board. They made it near impossible to get an authorization. If you are lucky and can get your doctor to give you one you need to register it with the LCB and get a "recognition card" from an I-502 retailer. Neither the LCB nor ANY retailer needs to know my medical information!
I would like to know exactly when or if the law suits have been filed. When I have that information I will donate and encourage my all my clients to do the same. I am happy someone is running with this but I need time frames so I can inform all my patients with the correct information.
Hi Janice! As we understand it, the lawyers cannot file anything until the law is enacted. A look at our one sheet on Update #3 will answer your question a little bit more as well. So where is all the news? The date has come and gone to file the injunction. A couple more days and the mmj industry in WA is dead. What are they waiting for? All the money in this industry and they can't raise enough to file after a year? They don't have time to update a web site or Facebook page to provide status? When something happens besides armwaving, I will donate. Most of the posts on this topic are a year old. Oh that's right. They can't file to save it until the state dismantles it and the players are scattered to the wind.

Compare the 1998 title and the 502 title - the law is being broken to illegally dismantle an almost two decades old very well run, self-policed community of very ill people. The laws are not the same, not by title and not by intent by title as the law above states; thereby, one of them is illegally changing the other. Medical cannabis which was voted in by this state's citizens in 1998 has illegally been hijacked. The lawyers in this gofundme know the above and have refused to move to get an injunction on these grounds. The lawyers are stopping all forward motion to a judge's chambers.
If you are a medical patient from marijuana please donate what you can we need to keep our doors open for us not for recreational use we are not a recreational person. We need to be able to get our medicine we do not use it to get high on we use it so we can live so please do not change our medical marijuana we cannot get it anywhere else but from our dispensaries. I just wanted to remind anyone reading this thread of one very important thing. If all else fails - JURY NULLIFICATION can make any law pointless. Nullify, always, if selected. However, if you are on the REGISTRY, good luck being selected for a jury in a cannabis case. Keep that in mind....
You, fellow citizens, are being taken and your rights as an individual are being torn from your very fingers as you watch. :( Please contact the Governor and ask why he broke the State Constitution - maybe in words I didn't use, maybe you can get through where none else of us can... Our State Constitution hangs by a thread, they are passing laws left and right that have nothing to do with the intent of the law and it's bankrupting us into non-existence. Compare the law/bill names. Read the internal text of some of the bills if you can digest them - they aren't true to the statute in the State Constitution. Congress is wrong. The Governor signed an illegal action and all other follow-on laws are null and void if the rule of law is to be the law of our land - or have we already lost and we now are told by the government that our votes meant nothing and will mean nothing? Know what really gets me? The people who, even if our press fails us, but don't seem to be on our side are the Sheriffs. Anyone ever heard of Sheriff Clarke? We need one now.
Please understand that our State Constitution itself states that this law is unlawful. Tell me the EXACT name of the bill this was given in the State Congressional Record and compare it with the 1998 Compassionate law not passed by an insane and lazy Congress, but by the people of this state as a blessing to the ill and the very poorest among us. Go read the above and compare the names of the bills they were passed under, if they are legal by any definition, I will give you computer service for a year - that's my expertise and what I can do as ill as I am. I am sickened by this State's leaders all the way to the Governor who signed this law after being told on his facebook that he was breaking the State Constitution - and this isn't the ONLY law that has this honor/disgrace! There are HUNDREDS that are as legal as the one they are trying to kill people here with their taxes, interference, and ignorance when we have a culture, a relatively safe if not in need of expansion, and well policed - we have MUCH less crime if you use per capita standards. WE can't accept more breeches of our rights by allowing those who are "leaders" to illegally pass laws that will harm businesses across the state, GENERATIONAL businesses with sick people inside and outside who depend on a medication that won't disable their existence like mine was for two years plus by so many drugs, I was drugged into not having a memory at all - I went from 128 to 200 in less than 9 months in Germany - Trazodone - AND others at the same time - all the while I am in pain, bleeding, trying to raise two children and not remembering the day before or the next or then next. Medical abuse is also a "thing" that is the elephant in the room that not one single person is addressing and it IS all of a piece when it comes to medical lobbys trying to keep a lid on just how bad some of their doctors really are, contracted, not at the top of their classes and research vacant after graduation, they only push pills or surgery (don't get me started THERE, well, yes, do , but not yet), or worse ignoring disease because one has no insurance - oh YES is does happen here in WA ladies and gents! Lobbys and incredibly shortsighted people who are "running" our State offices are doing horrible things in our names - we are the government - they are the adminstrators - and as such may not go outside the bounds of our most precious and important of laws, our State and Federal Constitutons. They all knew. Their "aides" would not allow access to them to say the words, not even a single email was forwarded to the Governor nor to any of the State Congressional officials whom we contacted and told they were outside the bounds of reason, compassion and the law. This illegal attack against the poorest and the most vulnerable among us, many are not getting medical care whatsoever in this culture of "I don't know you so you can't have what your records state and you haven't had a zillion infections from lung, to kidney, to liver, to brain, to pneumonias, bleeding sinuses for over three years and on and on, to an amoeba infection when I only drank bottled water if any and never had salad in Italy, not once, no way. I have been with insurance, homeless without insurance, and the homeless are not getting decent doctors and the lazy sots who fake being ill when they are not ill at all are taking from those who live on the streets - because my friends, 211 beds are non-existent unless you are chronically homeless, smoke and don't have any hygeine skills, communication skills, care for your fellows... don't we call that incompetent? Our mentally ill to worse are in the shelters along with a smattering of homeless and the rest are on our streets, in cars and in other areas where they can find a place to lay down for a few hours without terror and weather. This is an attack on so many things and the fraud that this engenders and the fraud that could be gone tomorrow if we had real doctors and humans who didn't scam the system is more than mind bogglingly insane - the savings in rooting out fraud alone would pay for real homes - not apartments for the poor who want to have a home and pay half what a renter does if they keep the property complete and yes some need a contract because they aren't used to being held to a standard or ANY kind - like those who pass laws against the citizens illegally... david: he clearly stated hes from oregon, so he has no idea what sb 5052 is.. or what we are dealing with in our state.. Jerald Mason: im unsure of oregon state laws, but they did just pass recreational in oregon, and its not that hard to get a medical authorization, to be able to get your own mmj. id talk to someone in your state who knows more about the laws. This is clearly a financial move on the part of the state. The way cannabis is sold in the "state stores" is a joke. For a person in pain, particularly a new cannabis user, it's necessary to be able to discuss, smell, ask questions. Not buy a pre-packaged product with info printed on it. I'm not being eloquent here, I'm trying, but this is such a blow.
