Peacemaker's Legal Defense Fund
Peacemaker National Training Center (PNTC) is a National Rifle Association (NRA) affiliated shooting club hosting a world class limited public use and private membership shooting facility. PNTC is the largest shooting sports complex and training facility on the East Coast and is also home to the NRA World Shooting Championship. PNTC, established in 2010, is a completely veteran owned and family owned small business. Their property has been in their family for well over 150 years and is the absolute center of the fight for the second amendment and for privacy rights.
Their mission is to provide the responsible law abiding citizen with an exceptional place to compete in firearms competitions, conduct training and practice the various legal disciplines of the shooting sports and overall firearms use. PNTC has seventeen ranges, which support virtually every type of competitive and recreational firearms use.
Located in Glengary, West Virginia (in close proximity to Washington, DC) PNTC is without question the number one driver of tourism in the county. PNTC creates local jobs, stimulates the local economy and provides world-class recreational activities to both local residents and visitors from across the country.
Now, after this family invested everything they owned into the building of the complex they are facing a potentially devastating lawsuit in civil court.
The Second Amendment to the United States Constitution states that the right of the people to keep and bear arms, shall not be infringed. Additionally, the Fourth Amendment to the United States Constitution proclaims that the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated. PNTC, whose owners support the constitutional rights of all American citizens, has always worked to guarantee that it's members and patrons can exercise these constitutional rights granted to all American citizens to the fullest. Now PNTC needs your help and assistance to beat this lawsuit and ensure that the complex remains a place where responsible law abiding citizens can practice the various legal disciplines of the shooting sports and overall firearms use.
Specifically, a resident of Virginia has filed a nuisance complaint against PNTC alleging that noise from normal operation of the shooting range is a nuisance, and therefore interferes with his property rights. This complaint was filed in Berkeley County Circuit Court and is before Circuit Court Judge Grey Silver, styled Ben and Diane Goldstein v. Peacemaker Properties, LLC and Peacemaker National Training Center, LLC, Civil Action No. 15-C-520. Court documents filed in the case are public record and may be reviewed through the Circuit Clerk’s office.
Although our legal team pointed out that Berkeley County, WV specifically exempts shooting ranges from their noise ordinance and prevents nuisance claims against shooting ranges, the complaint was filed and not dismissed by the court. You may also access the Berkeley County Noise Ordinance at the following link: Berkeley County Noise Ordinance.
Despite numerous motions and requests to reconsider, and numerous mediation efforts with the plaintiff, the court has ordered PNTC to produce the below documents and other private records under a “Protective Order.” Under this order, the plaintiffs and their counsel are legally permitted to access the following private information:
- All private member files.
- All waivers from any person who has accessed PNTC, to include names of all law enforcement officials, federal agency personnel, military personnel and foreign military personnel.
- All shooting competition files and lists.
- All training information and lists.
- All customer waivers.
- Identities of all persons who have used PNTC ranges.
- All ATF and NFA records (to include Forms 4473 and ATF bound book information).
Please donate to this campaign in support of our legal defense efforts and help us defeat this lawsuit and protect the constitutional and privacy rights of our patrons and members. The owners of PNTC will be forever grateful. Thank you for taking the time to read about our campaign. We sincerely hope to hear from you all soon.
