The Supreme Court of Canada has agreed to hear our voting rights case!

Our voting rights need to be affirmed by a Supreme Court decision so that they can never be taken away again by politicians.

That is why this court case remains important.

Background:

In 2012, two Canadian citizens living in the United States, Gillian Frank and Jamie Duong, filed a lawsuit against the Canadian government to restore the voting rights of Canadians living abroad. The law firm Cavalluzzo Shilton McIntyre and Cornish has represented Frank and Duong and is preparing to take this case to the Supreme Court of Canada.

Update:

Dear friends,

Election 42 is now over and we have a new Liberal government in power that seems supportive of restoring our right to vote. This change in government is reason to celebrate and to press forward with our cause.

During the election, Canadians living abroad made their voices heard in countless ways. We held a rally in New York City, we wrote letters to the editor and we lobbied all major parties to support our cause (and the Liberals, NDP and Green Party did so!). Many Canadian expat groups held election night viewing parties and some Canadians traveled back home at great personal cost to vote in person. Donald Sutherland spoke out in favor of expat voting rights and two expat Canadians even ran for Parliament to raise awareness about the need to restore our voting rights. All of this activism drew media attention and reframed the conversation.

Now it is time for next steps.

Last month we filed the paperwork asking the Supreme Court of Canada to hear our appeal.
The Attorney General's response was due the last week of October. At the last minute, the Attorney General's office asked our lawyers for a two week extension to submit their paperwork. They are seeking the extension because they want to ask the new Liberal government (and whoever is appointed Minister of Justice) for guidance on how to handle our case on expat voting rights.

Traditionally, incoming governments continue the litigation of previous administrations. However, we have an opportunity to try to get the new government to change course on Frank & Duong v. Attorney General.
I encourage you all to write to your MPs and any of your government contacts in the Liberal Party and request they do the following:
1) Do not challenge our request for leave to appeal the Frank & Duong v. Attorney General case at the Supreme Court of Canada
2) Should the Supreme Court of Canada agree to hear the case, do not defend the litigation.

We're at the halfway point in the 2015 election campaign. And our fundraising campaign has just reached the $10,000 mark.

So far the NDP, the Liberals and the Green Party have all expressed support for our cause -- the right of Canadian citizens to vote no matter where they live.

We should cheer for the fact that these parties have all supported our right to vote and we can hope for policy changes in the future if these parties take power. But these rights also need to be affirmed in a Supreme Court decision so that they can never be taken away again by politicians.

And an even greater injustice is that foreign born but citizen children of Canadians abroad must have their baby in Canada or their children can not automatically become Canadian citizens. I thought Trudeau said that there are no second-class Canadians?
