Please please help my family!!
We are being taken advantage of by our mortgage loan provider. I am certain that what they are doing cannot be legal, but we realistically cannot fight them.
THEY GAVE US LESS THAN A MONTH TO PAY $20,000.
We missed our mortgage payment in February. The mortgage is $3,200 each month, because they gave it to us for an insanely high rate. We’ve been able to keep up with it up until now but suddenly there’s been much less work and so we missed the February one.
They first sent us a letter on April 4th telling us to pay for February, $3,200 plus an insane amount of fees, totaling just over $6,000 that they wanted from us. They gave us until April 9 to pay this, or else they would take legal action, and we were unable to come up with the money that quickly.
The payments are meant to be automatic. In March, when we did have the money, they did not take it even though they were supposed to. My dad had even messaged them telling them to take it and they would not. We are certain they did this purposefully so that they could now have “two” months of “missed” payments over us. They need three months in order to be able to take action to repossess our house. They then told us we needed to pay for March as well when they had originally only asked for February, and it was not even our fault that the March payment was missed.
Then, they decided to add April and May into it. Mortgage x 3 = $12,800 (plus the high legal fees they keep stacking on us) totaling $20,000. Almost half of that is just legal fees! $5,000 for their lawyer who did nothing but send us a single letter and then avoid us and ignore all the questions we had for him?
Within a span of few days, they keep changing their own story. They just keep adding to it!!!
The very first letter we received was on on April 4. The most recent letter, the cover image of the gofundme, is from April 18. In just these few days, they added so many more payments into it? And now, since they keep changing their story, they have these three, even four months on us! If we are unable to pay this, they will repossess our house and evict us. They are now demanding a whole $20,000 from us that we have no idea how we are supposed to get.
We were eventually able to get together $6,000 and quickly sent them a bank draft for the money, only for them to send it back a few days later. They told us that they will not accept the money unless it is the full amount.
We find this extremely sketchy. If they want the money so bad, they should have taken the $6,000 and seen that we were making an effort to pay it off. Instead, they refuse it unless it's $20,000? $20,000 that they hadn't even asked for until now? We highly believe that they are only saying that because they know we will not be able to get $20,000 and they want to do all that they can to take our house away from us.
It is so crooked, that they are actively taking advantage of people like this. These people are loan sharks!
I would have liked to contact a lawyer but my father (it's my parent's house, though I do live here and am just trying to help them in any way I can) says that if we take action against them, they will come down on us even harder. I would not be surprised if they did this... With what they are already demanding from us, I'd expect them to demand the money from us even sooner, or possibly even add a higher amount for "public slander"...
My father thinks that the only thing we can do is try to pay this amount in order to get them off our backs, and sell the house as soon as possible. This is the goal we are trying to focus towards... I've been told to file for bankruptcy but that is an absolute worst case scenario that we are trying to avoid. It's not a good solution... If we can just sell the house, hopefully before May 20th, then we will have enough money from selling it to pay off the mortgage debt and move elsewhere. If we went bankrupt, we would have nothing. The house has been listed up for sale for 3 weeks now and we really need it to sell as soon as possible.
My father is working as hard as he can... He installs floors, but is getting extremely little business, when usually at this time of year he should be flooded with work. We have no idea why it is going so slowly. He has a few things scheduled for this week, but for next week all he has is a small job on Monday and that's it...
I am applying for all the jobs I can, but have yet to be contacted back by any. I am also selling art commissions. Here is my Etsy shop if you might be interested, so that I can give something back to you.
We have very little family, but my grandma has tried to take out a loan for us. She was denied due to her age...
