Lawsuit filed to preserve religious exemption!

What if someone told you you must administer medicine to your child who is not sick even if it violates your religious tenets and practices?  

This violation of our constitutional freedom is happening now and is being brought to a new level of intensity in our culture.  Most Catholic Bishops in Florida are overreaching their authority and violating the freedom and sacred conscience of the Catholic family with their new policy of rejecting vaccination religious exemptions lawfully claimed for children by their parents in diocesan schools.  Until now, they have always honored a family's legal claim to vaccination exemption based upon their beliefs and practices. Beginning in the upcoming academic year under the new policy, no family may refuse vaccines and receive a Catholic education for their children.  This violates the teachings of the Catholic Faith and the sacred bond of the family.  It is also a clear violation of the laws of the State of Florida (FL statute 1003.22)

These are our children!  They do not belong to the bishops!  This is our faith and contrary to what many may believe, our faith does not belong to the bishops either.

After exhausting appeals to reason, we are having to confront this violation of the family and Florida statutes in a court of law.

Please help us bear the mounting financial burden of this effort to preserve our freedoms and demand the Catholic bishops obey the law.

It is a dark day for medical and religious freedom.

Today, the Florida First District Court of Appeal denied our appeal and affirmed the lower court decision. In a twist of sorts, the appellate court in the name of religious freedom actually upheld religious oppression (as practiced by religious leaders themselves) against individual American citizens. Now there isn't a bishop in the country that could feel uncomfortable expelling all unvaccinated children from his Catholic school.

Of course, we were seeking relief from the state to intervene on behalf of their own vaccine religious exemption law. That was unavoidably problematic from the start considering the states invented forced vaccinations in the first place.

This is initial commentary from one of our attorneys, Alan Phillips:

"The disturbing implication is that the church may randomly assert that anything is 'religious' and thus control whatever it wants, under a false pretense of 'religion.' Immunization is, inherently, a scientific-medical matter and thus not 'rooted in religion,' as required by law to be a protected religious belief, and it addresses public health, which provides the necessary basis for the government to address it without intervening into religion."

For those who would celebrate what happened today, I will issue this sober caution: Be careful indeed. The demon of government forced medicine may soon visit your door veiled in another form... and your pastor may be standing right beside him.

A hard part of this is continuing to try to raise funds with this vehicle to pay our legal fees. The notion of our losing will no doubt hinder or perhaps prevent altogether our ability to pay our legal bills. Nonetheless, I make the appeal. Please help us if you can.

Case Update:

It has been six months since we presented oral arguments before the Florida First District Court of Appeal. We are still waiting for the Court to rule on our case.

I have contacted the Court Clerk. The clerk has indeed confirmed the case is still before the court but can say no more.

What does this nearly unprecedented length of deliberation mean? It is impossible to say.

Remember, it is wrong and outside the holy duty of any church leader to leverage Christian education against forced vaccinations. In doing so, they are violating the sanctity of the Christian family as well as Florida Law (1003.22).

Case Update:

We are still waiting for the Court of Appeals to rule on our case. On February 21, it will have been 4 months since we presented oral arguments before the Appeals Court (Florida 1st Circuit).

During this time, the Bishop has been active in attempting to influence city legislation in Jacksonville. What's interesting is a portion of his wording in the letter he issued to the Jacksonville City Council:

He wrote: "Formed by constitutionally protected religious beliefs which we have held from time immemorial, our consciences – and the consciences of all citizens – have long been held to be sacrosanct in many areas of civic life. "

This is troubling. He is justly advocating for religious freedom on the one hand while denying that very same freedom to his own flock on the other.

Bishop Estevez, it is wrong and outside your holy duty to leverage Catholic education against forced vaccinations. In doing so, you are violating the sanctity of the Christian family, the Catechism of the Catholic Church and you are violating Florida Law as well (1003.22).

My son was just kicked out of Catholic School in Philadelphia because we originally signed a moral/religious waiver. We are not Catholic and were hoping our beliefs would be respected. As a former public teacher I will not enroll my son in public school. This absolutely ridiculous! The Catholic Schools are struggling terribly to keep schools open.

Most relevant to me if someone could help please, ...... is that my children need to go to a private religious school. If I understand this ruling correctly, our school cannot exclude my children provided our reason is NOT religious for refusing vaccinations? am I concluding correctly? This is nothing new. Since the founding of the Roman Catholic Church there has been corruption, lies, hypocrisy, cooptation, perversion and worse. The Roman Catholic Church (and their Jesuit henchmen) are not even insurable against child molestation. Look up The Borgias (Popes whose corruption and abuse of power was beyond imagination). Even more recently, the Pope (at that time) was photographed shaking hands and smiling with Hitler during WWII. Vatican City money (one of three cities within a city) is managed by Rothschild bankers. Billions starve while the "Church" grows ever richer. The Roman Catholic Church has never been bothered to follow any law other than their own. Look at the testimony of former Nuns who were tortured; whose illegitimate children were aborted and buried secretly on Church grounds. Look at the dungeons and torture chambers of this "Church of Satan". Study the Inquisition of the Church and tell me that this is a holy, godly religion or one of control, corruption and the Devil.

Hi Patrick and family. Thanks for standing up to the Catholic Church regarding the issue of religious exemptions for vaccinations. The same thing is happening here in Atlanta. I sent a letter to Archbishop Wilton Gregory and received a disappointing answer back (I sent you a private message on your facebook page regarding this matter). This issue does not affect me personally as I do not send my children to catholic schools, but I attended Catholic Schools my entire life, and this issue really bothers me.

I encourage everyone to sign up for the NVIC Advocacy Portal (nvicadvocacy.org) We at NVIC monitor every legislative session and send action alerts to fight against state infringement of our rights of religious and medical exemptions.
