Lawsuit filed to preserve religious exemption!

What if someone told you you must administer medicine to your child who is not sick even if it violates your religious tenets and practices?  

This violation of our constitutional freedom is happening now and is being brought to a new level of intensity in our culture.  Most Catholic Bishops in Florida are overreaching their authority and violating the freedom and sacred conscience of the Catholic family with their new policy of rejecting vaccination religious exemptions lawfully claimed for children by their parents in diocesan schools.  Until now, they have always honored a family's legal claim to vaccination exemption based upon their beliefs and practices. Beginning in the upcoming academic year under the new policy, no family may refuse vaccines and receive a Catholic education for their children.  This violates the teachings of the Catholic Faith and the sacred bond of the family.  It is also a clear violation of the laws of the State of Florida (FL statute 1003.22)

These are our children!  They do not belong to the bishops!  This is our faith and contrary to what many may believe, our faith does not belong to the bishops either.

After exhausting appeals to reason, we are having to confront this violation of the family and Florida statutes in a court of law.

Please help us bear the mounting financial burden of this effort to preserve our freedoms and demand the Catholic bishops obey the law.

Case Update:

We are still waiting for the Court of Appeals to rule on our case. On February 21, it will have been 4 months since we presented oral arguments before the Appeals Court (Florida 1st Circuit).

During this time, the Bishop has been active in attempting to influence city legislation in Jacksonville. What's interesting is a portion of his wording in the letter he issued to the Jacksonville City Council:

He wrote: "Formed by constitutionally protected religious beliefs which we have held from time immemorial, our consciences – and the consciences of all citizens – have long been held to be sacrosanct in many areas of civic life. "

This is troubling. He is justly advocating for religious freedom on the one hand while denying that very same freedom to his own flock on the other.

Bishop Estevez, it is wrong and outside your holy duty to leverage Catholic education against forced vaccinations. In doing so, you are violating the sanctity of the Christian family, the Catechism of the Catholic Church and you are violating Florida Law as well (1003.22).

Case Update:

We presented oral arguments before the Appeals Court on October 21. The court has not requested anything else from either side sincethat time.

Therefore we are simply waiting for the three-judge panel to issue their ruling.

In the meantime, the Diocese of St. Augustine is digging their heels in with their new immoral policy. I have heard from yet another family who is being oppressed and strong-armed by diocesan officials because they possess an official medical exemption.

Diocesan officials are subjecting the exemption to a "second opinion" from a panel of doctors of their choosing and are threatening to expel the family's child from the Catholic school if they deem the exemption is without merit.

This Marxist-type oppression must stop!

Case Update:

Oral Arguments before the Court this Friday.

The bishop has submitted a document to the Court just 6 days before the hearing in an effort to defend the indefensible, namely that a policy of forced vaccinations is a tenet of his faith (that is his latest argument) entitled to the same constitutional protection as my legal claim to the Religious Exemption under existing law. This is as sad as it is shocking.

The document he submitted is an article published by a doctor with personal ties to top management in the biopharmaceutical industry. The article titled, The Moral Obligation to Vaccinate is disclaimed by the National Catholic Bioethics Center as not necessarily representative of their position even though it was published in their quarterly newsletter.

The article is biased, meaningless and morally suspect. One line from it reads:

“A person’s choice not to vaccinate himself or his children excludes certain members of the community from full participation in society.”

In contrast, The United States Conference of Catholic bishops recommends the Religious Exemption be honored by all bishops in their schools in places where it is honored for public school students.

Help me please to fund this fight for justice and religious freedom. This battle cannot continue without your help.
