Help Dylan Keep His Ducks

Dylan is our 12 year old autistic son with two ducks as his Emotional Support Animals, Nibbles and Bill. We live in Georgetown Township, MI.  This summer some in our community complained about Dylan having ducks, and we were told to remove the ducks because it violates local zoning ordinances. This would devastate Dylan as he needs these ducks to function at his best, so we won't give up that easily.  

As someone with a disability, we believe his ducks are protected as Emotional Support Animals (ESA's). We also believe that Dylan is protected under various laws because of this disability. As such, we have been fighting for Dylan to keep his ducks and retained lawyers who have helped in many areas. They generously donated their services at not cost to get the ball rolling. They wrote letters and advised us on what we could do for Dylan, and we are very grateful for that. However, the amount of time and effort has gone beyond the initial agreement for services and the costs are now coming in. 

People have been asking for some time how they could help, now there are two ways to do so.

First, donate to offset the costs of the legal battle as we have received an invoice from the lawyers for over $5,000. This is for the time and effort in dealing with the township appeal process (which they have done a great job with), research into current laws and regulations, dealing with the HOA. This is after a lot of pro-bono work that they did to get us  going by writing letters, and advising us on what Dylan's options are. . Dylan is one of five kids, so you can imagine this amount is more than we can handle. Any donation will help Dylan keep his ducks and the effort it takes to do so by paying the legal fees. As money is collected we will send it to the legal team.

Second, we have a meeting with the township in late August to determine if Dylan can keep his ducks. If you are able, attend the meeting in support of Dylan. Those complaining have not stopped their attempts to have the ducks removed, they have been complaining even more to the township. It is our hope that a this meeting it will be decided that Dylan can keep his ducks because the law allows for it. Thank you for considering helping Dylan keep his ducks. We don't expect anything, the support for Dylan has been nothing short of amazing. But we know many have wanted to help in others ways so we are offering these two options.

Thank you to those that have contributed towards this project. Although the final material quote came in and it is greater than the go fund me campaign, it will not stop us. We are confident that the money will be raised and we will be able to pay the lumber company. We have applied for and have been given the building permit from the township. The weather has turned so we need to move quick to keep Dylan, Nibbles, and Bill dry with a new coop that Dylan wants to name the “Quack Inn”.

The fight for Dylan to keep his ducks is almost complete. Your support has been remarkable and very appreciated. Because of your generosity we were able to pay some of the legal fees associated with the fight to keep Nibbles and Bill.

After the township voted overwhelmingly for Dylan to keep his ducks they provided guidelines for how they are to be kept. In working with the Homeowners Association and Township we are going to make some modifications. In short, we need to build a different enclosure. Details can be found at the link below.

We have established a different campaign to address this issue. We are grateful for your contributions to the legal fees and do not want anyone to feel pressure to contribute to the next campaign. The township has agreed that Dylan can keep his ducks under specific restrictions. We (and Dylan) have so many people to thank for their support during this summer long ordeal. The team at Bolhouse Hofstee & McLean PC (Jake Lombardo, Christine Lynn Welton, Michelle Lang Mclean), the Fair Housing Center of West Michigan, friends, family, and all of you. Many of whom we do not know or have ever met. Your love and support has helped us and Dylan through some very dark and scary times. Thank you so very much for encouraging us and advocating for Dylan online.

This boy is happy that he gets to keep his ducks and continue to live his life with them and their support.

Now we need to work on an agreement with the Homeowners Association and we can put all of this behind us.

It looks like Dylan will get to keep his ducks!

The board postponed the final decision to the next meeting to work out details of how they will be kept, the pen, etc. but before postponing they did say they they all agreed on Dylan keeping the ducks.

The next meeting is in a month and there is a lot of work to do, but we remain confident that we can come to an agreement!
