Legal Help for Dumitru Popescu
Dumitru Popescu wins Grand Jury, alone, without adequate legal, help. 18 charges dropped. Revengeful DHS agent is deporting him anyway.
Dumitru Popescu, CEO of ARCA Space Corporation, was falsely accused and arrested in October of 2017, with several charges of securities fraud. These charges turned out to be based mostly on statements from Dumitru’s ex-wife and a predatory investor whom Dumitru had previous conflicts with. Without any solid evidence to support these charges, the New Mexico Securities Division had Dumitru arrested and he spent a month in jail before being released on bail.
When Dumitru was released, an agent from Immigrations and Customs Enforcement, a Department of Homeland Securities, who participated in the State's investigation interviews, harrassed Dumitru and his family, telling him he “doesn't exist”, that “he owns him”, that “ARCA doesn't exist” and that he should “sell his company to Michael” and referred to Dumitru and his family as “gypsies” in a witness interview with his ex-wife. He took possession of Dumitru’s passport and cancelled his current business visa. The agent informed Dumitru he had a pardon to allow Dumitru to stay in the US for the duration of his court case.
Dumitru spent the next 6 months in a legal battle with the State of New Mexico, which he eventually won at the second hearing of the Grand Jury, in which the Jurors, made up of 12 New Mexico residents, returned a “no bill”, refusing to indict Dumitru on any of the 18 charges. The prosecutor then dropped all charges. At this point, Dumitru immediately began working to restore his legal status in the US. Rather than accepting Dumitru's Grand Jury win, the DHS agent stalled on giving Dumitru’s passport back to him, acting like he couldn't find it, and took him into custody on May 18th, just 1 week later, on the grounds that Dumitru was no longer in the US legally.
Immediately following his Grand Jury win, Dumitru found a new immigration attorney with whom he was in the process of submitting documentation for his EB1 visa. The attorney believes this would have stopped any deportation procedures. The DHS agent has repeatedly dissuaded Dumitru from getting help from attorneys during the past 6 months, telling Dumitru he knows the law better than attorneys, and that no attorney can help him. The DHS agent was preventing Dumitru from raising funds, and picked him up on a Friday, preventing paperwork from being filed over the weekend.
Dumitru was taken to an immigrant camp in El Paso, waiting to be sent to Europe with no given date for his release. The DHS agent denied him the right to be represented by an attorney, telling Dumitru something to the effect of “You have no rights”. His new attorney attempted to contact the processing center, but was denied access to Dumitru.
Dumitru’s immigration attorney is working diligently to adjust Dumitru’s status, and free him from the processing center, but the estimated cost will be around $15,000.
The past 6 months have completely drained Dumitru's resources. We need to raise this money, and free Dumitru from this situation as soon as possible, as the estimated time of deportation is not guaranteed. When he was thrown into jail last year, he was told he would be extradited to New Mexico in “a few days” which turned out to be more than a month before finally being transported to New Mexico and having bail posted. By this time, he had lost nearly 40 pounds because of his medical condition.
Anyone who has followed this story knows that Dumitru has gone above and beyond to successfully prove his innocence, and despite this, he continues to have his rights blatantly abused. We ask that you provide whatever you can to end this injustice and allow Dumitru to continue his life’s work in aerospace development.
