#JUSTICEFORSALLY, 96, LEGAL FUND

As seen on KCBS News - 96-year-old Sally Ann is being evicted by her assisted living facility - Cityview in Los Angeles. Sally has security cameras in her unit that have exposed how they operate (ie, don't respond to calls for help, don't provide services they charge for, don't honor their residency agreement, etc.).



Sally, who is handicapped, prepaid Cityview monthly, from March-September 2017, for base rent and services (e.g., dressing, hygiene, grooming, showers, etc.) but each month Cityview failed to provide 80% of the services they were charging for while harrassing Sally about getting rid of her security cameras. They even called her a criminal even though she provided them with written statements from the Los Angeles Police Department that stated she was doing nothing illegal by having the cameras in her unit.

Sally asked Cityview repeatedly to credit her account for the non-receipt of services her security cameras documented daily but Cityview refused and continued to invoice her for them. So Sally gave them notice, per Lanlord-Tenant law, that she would be deducting the amount she was due from future rent. When she gave them the next month's rent, minus the amount she was due as a refund ($7,500+), they wrote her a letter that said they were returning her check (they didn't) and instead served her with an unlawful detainer a week before Christmas.

Sally's on very limited funds. Fighting the eviction is  too expensive for Sally, a retired detective and 20-year CHIPS (Citizens Helping in Police Service) volunteer until age 94. 

Any donation is greatly appeciated. Her attorney's hourly is $400 and it is estimated her defense, over the next 2 weeks, will cost upwards of $10,000. 

Note: Cityview is also planning to file a second unlawful detainer against her should she win this eviction. They have written her a letter accusing her of violating her residency agreement by what they allege as inappropriate behavior. These accusations are lies. Sally was agitated for a few weeks but this was due to a severe bladder infection that Cityview failed to report, in addition to severe dehydration (Cityview was responsible for preventing) that resulted in a week-long hospitalization for a salivary gland infection.

Hello Sally supporters!

What was supposed to be a 3-HOUR unlawful detainer trial turned into a 3-DAY trial with no verdict - yet.

Judge O'Donnell asked both sides to submit a brief by February 16th that states the relevant law concerning State policy issues on what constitutes base rent for basic services (Cityview added additional service fees to the 30-day notice when State law states a resident can only be evicted for non-payment of basic services) and whether a facility can evict for non-payment of additional services the resident did not receive the benefit from.

This means Sally's case will end up being groundbreaking for all seniors in Sally's position going forward. The judge's ultimate decision in this case will be referenced in senior eviction trials in California.

Sally attended 2 days of the trial. On the second day, after she left her apartment, Cityview staff entered without her permission, looked through her personal belongings and took pictures with their cell phones. We have filed a police report.

We've yet to reach our goal for the 3-hour trial and now we've been told the bill will be astronomical for the 3-day trial and 2 additional weeks of research for the final brief to be delivered to the judge.

Hello Sally supporters!

Thursday Sally appeared in court against City View ALF, Inc for the eviction. She spent 8 hours waiting around for a trial that never happened (stressful for someone her age and also costly in legal fees). City View had filed a motion to prevent Sally from using any and all of her evidence (video, photos, witnesses, etc) of their fraud and neglect but a judge was not available to rule.

The matter has been continued to this Monday. I will report back asap.

Happy New Year.

Quick update on Sally...

She's just recovered from the flu (thanks to her doctor giving her Tamiflu 48 hours after first symptoms), in addition to an unreported bladder infection and is now enduring an allergic reaction to an antibiotic. A lot of stress to endure in addition to being worried you're going to be kicked out of your home in a few weeks.

The trial date for the unlawful detainer has been set for January 25th. We've been preparing a bevy of evidence with our attorneys. To date, we've spent $4,500 on legal fees and raised $3,500 of our $8,500 goal. We are confident we will prevail.
