The ERD court in South Australia on the 21st January 2016 have deemed Market stalls as "Shops" there for concluding a group of stalls is now deemed to be a "Shopping centre" under Australian development law.

The flow on effect means any stall or alloted area to run a stall that is used for the display or sale of goods, will be treated as a shop, making Stalls, Markets, Community events and even Garage sales "Non compliant" in most locations markets and community events operate in Australia.

This has the ability to shut down most Markets and community events, as most operate in car parks, open spaces or road ways.

The money raised will be used to fund a legal action to appeal the Development courts decision in the Supreme court (full bench) to restore Markets and similar events to be again considered merit use applications.

If an appeal is not lodged with in 21 days, by Mark Aldridge or the City of Salisbury, the finding will stand, and has the ability to undermine all community events that utilize portable stalls.

The money raised will be used in several ways, firstly to cover filing fees, secondly to cover legal costs (most of the legal arguments will be provided pro bono) secondly to ensure the applicant dies not have to cover any fee's assocaited with a loss in the courts. thirdly to cover a second appeal if their is suffiecient funds, and finally if the case is won, any money held in this account will be donated to those who lost their homes in the Pinery fires (Those who for one reason or another, lost their homes and are not covered by insurance.

I have spent years promoting healthy eating, and buying Australian, and I run a couple of Adelaides most successfull inner city markets. I opened these markets to protect our smaller farmers and producers, who with out Farmers Markets would lose their farms and small businesses.

I started my actions and markets to stop Australia becoming a net food importer and to restrict the big duopoly in the grocery industry from taking ful control of our food industry, and to ensure our producers can resist foreign take over.

Farmers Markets, Fetes and Fundraising events are an important part of Australian culture and history, and I believe they will play a very important role in maintaing affordable, fresh and safe produce into the future.

I promise to be totally accountable for every dollar raised, and will donate my time and experiance in any way I can to ensure the legal action is a success.

By Googling my name or Farm Direct markets, I am sure you will find enough information on me, to have faith in what drives me to ask for your hard earned money.

I am also asking all my stall holders and customers to please donate $50 to $100 each, each family should be already saving that much on their grocery bill each week, and each stall holder will make that back at one market.

I would run the case on my own and fund it, but I cannot afford to risk my home if we were too lose the appeal, as my wife and I also run and fund our own native wildlife sanctuary, so my home is the castle of many.

I believe that we can win the appeal, and I have been working as many know with the vicitms of recent disasters, so it will be a great win for the people, the producers and those who lost everything in the fires.
