Hello every one I'm raising money to bring Capone home, Aurora animal control has my beautiful dog and won't give him back they are saying he is a hybrid wolf which he is not we are waiting on DNA test results to prove that,he doesn't act or look like a wolf, if we don't get him home they will put him to sleep due to wolfs not being allowed in aurora. I just want my baby to be back at home with his loving family where he belongs and I will do anything to make that happen. This money is going towards legal fees, a 6 ft fence and shelter costs to help get Capone home.Thank you for reading my story and for your help. All funds raised beyond the stated costs will be donated to a local German shepherd dog rescue in Colorado.

Hello Abbato family, I am very upset to hear about this situation with Capone; I'm not sure if you're aware of this but Colorado laws regarding 'exotic' animals, Chapter 11 clearly states that domestic canines, including hybrids with wild canids are considered domestic. I'm no attorney, however, it looks clear to me that Colorado sees Capone as a domestic animal - however any DNA test returns - per Chapter 11, and thus should be returned to your family immediately. Rick Moody Sandra, good to hear from you.There.is no such thing as a wolf "hybrid". A "hybrid" is a is the result of the mating of two different species such as a lion x tiger = liger. In 1993 the wolves and dogs were determined to be the same genus and species, Canis lupus. Therefore, even DNA cannot distinguish between them. Section 8-2 of Denver law states that wild or dangerous animals shall not be kept by individuals. However, it only lists poisonous reptiles, etc. but does not state wolf. This restriction does not apply to the rest of Colorado. Several years ago my insurance company threatened to cancel my homeowners insurance because I have a 100% grey wolf. I threatened to take them to court because first, they could not prove that he is a wolf, and second, it is not illegal for me to own him. I later received a personal apology from the president of the company. As far as dangerous animals are concerned I have been bitten several times by my mother's 3lb. Yorkie. Capone is a beautiful animal, but I doubt that he is even part wolf. The officials in Aurora, Col. are totally wrong and the owners should fight this. Hello! I would like to talk to you and your attorney about your case. I had a case that Aurora Animal Control chose to pursue even though there was no proof of a bite! No medical report and no witnesses! Only a blurry picture of a bruise on a guys leg. My dog never bit him but I still had to pay a fine because of the unfair ordinances in Aurora. I am a dog expert and dog obedience expert. There is no way to prove that a dog is not a wolf through DNA because all dogs carry wolf DNA! Have your attorney call me 720-877-3966. I am going through the same thing with the Aurora animal control... It is true that they label any animal as vicious or aggressive in order to cover up what they are really trying to do. I saw this with my own eyes. I was forced to surrender our dog because we did not have the money to keep paying their impound fees. They sent me a phony looking DNA test saying our dog is a pitbull. I paid for this DNA test including a microchip which THEY SAID is required in order to test the dog. $120. I should have known better all they're trying to do is get money from people and in this case it's money I don't have. We have a court on the 31st. We are fighting against fees and fines that add up to around $1,000 or more. We won't get our dog back they forced us to surrender him because we did not have money. They came to my house and straight out LIED to us saying all they wanted to do is take a look at our dog and they put him in a van and took him away without our consent. Our poor dog blue was barely 10 months old he has never hurt anyone and is very obedient and friendly.

Hello. I have been thinking about your case. I would like to tell you that it is very important to get a second opinion. Nearly any vet can do a DNA test on your dog, Capone. It is not necessary to send the sample to a University for testing. I recommend Animal Care Center of Aurora, ( Dr. Robert Foglia, DVM, 303-693-6640). Just from looking at pics of this dog I would guess that she is a German Shepard/Border Collie Mix. But I would have to evaluate the dog in person to know for sure. I hope you get lots of help to fight for Capone. I have shared Capone'a story in all 4 of my fb pages asking them to be his voice and to call the Mayors office, which I have done twice. I will fight along side you in spirit and will do so for my Sammigirl. Truth is, this could happen to anyone's dog as all dogs are decendents of the wolves. I had a GS several years back and he was sweet and gentle, but can be protective when need be. That's what makes them such great dogs, even if a mix. Keep fighting. There'a an army out there fighting for your baby so take comfort in that. We must all demand that city pay the attorney fee's for you.

The law "looks" to be on your side as it does not specifically state wolf-hybrid as is a German Shepherd. These dogs have been bred so many times since the originals that they would be diluted genes by now; however, they will have the wolf gene in it's DNA still. I pray they give you your baby back and soon. He does not belong in the shelter, but at home with his loving family.

If the DNA test doesn't come back in his favor, maybe you can find a home for him in a state that's not backwards. Getting him released from his wrongful imprisonment may be the hard part. They seem hell-bent on killing him for some evil reason. These nazi agencies have got to be stopped. Either way, sue them, maybe you can get people fired, and get the right people into the job that actually care about animals.

It seems to me that it is time for all animal lovers to take a group action against Aurora Animal Control. I got a dog, a long time ago, that had spent many months in Adams County shelter. It's time to stop the bad behavior of the animal control folks in some of the towns in our State. There are some very good comments in this trail and several other folks that apparently need assistance with fighting Aurora - the time is now. Ban together and work as one! Find a reputable canine attorney - there are several in the metro Denver area - it's time!

Please do a search for Flat Coated Retriever German Shepherd mix on Google images and you will see many dogs that look like Capone. (http://www.adoptapet.com/pet/1611440-bellflower-california-german-shepherd-dog-mix) My family and I are proud pet parents to a Flat Coated Retriever/Border Collie mix and a Flat Coated Retriever/Spaniel mix. Flatties are a rare breed that most people are unfamiliar with and would not recognize. Many Flatties have been cross bred with more common breeds as I suspect in your Capone. Flatties have your dog's face, coat and tail, otherwise I see the German Shepherd in the ears and chest. Capone is not a wolf hybrid, but he is a Flatty/German mix. Use the Google Images to demonstrate it for the judge. Good luck and god bless.

Give this dog back to the owners. You have no right to keep a dog that was rescued from a pet shelter to begin with. This is a complete overreach of the responsibilities of the animal shelter. They are here to protect pets not take them away from families who love them. The goal of any shelter should be to Protect and serve, not to hold hostage and torment

I wish i could have donated more . But pray your baby can be returned to your home . He is a part of your family and having him from another shelter and for 10 years the system should recognize he isnt a threat . And a loving pet family member with caring people who love him .its really sad and my heart hurts for you guys

It might be a defense in a courtroom to review the motive for any local ordinance that prohibits owning a wolf etc. The motive is more than likely concern for citizen safety. Capone's 10 year history probably has no examples of wolf-like behavior....and from that photo, I assume the complete opposite. Some common sense might prevail when offering an option to be returned to a wolf environment. This is a sad case when public officials forget it is ok to exercise common sense....If he were to be euthanized I would hope the deciding governmental authority would also consider the enormous backlash and huge fund for law suit the next GoFundMe site would provide. Any elected official involved would, hopefully, begin planning their next career.

I give you money, not just to help you get your dog back, but to help set a precedent for the freedom of others. Please, regardless of what happens (and I hope UC Davis' results come back in your favor) counter sue this organization for everything it's worth, and more importantly, slap civil law suits on individuals who work there for the damage they've done to your family, emotionally and financially. Be sure to include Jenee Shipman, who, based on the volume of complaints I've read online about her over the last few years, seems to be out for herself and not at all concerned about the welfare of animals in her care. I'd also suggest you get your lawyer well-educated in dog DNA. It's actually difficult to draw a line between "domestic" dog and wolf, as discussed in this online document. http://www2.fiu.edu/~milesk/Genetics.htm. In addition, I'd suggest lobbying for educational and licencing requirements for AC officers who have this type of "power", so people with a "hunch" or "opinion" can't wreak so much havoc against innocent people and their pets - the very people they're being PAID to supposedly serve. My heart goes out to you and Capone - I am hoping for the very best outcome.
