Due to sheer Negligence from our HOA, my friend/roommate Nikki and I have had extensive damages to our home of two years and to our personal property. Not only have we already lost so much, including irreplaceable items, but now our HOA is refusing to reimburse us for our losses! The HOA is responsible for the roof. Because they failed to maintain and fix the roof properly, the events that then transpired included flooding, ceilings collapsing, contamination of mold and asbestos, red-tagging by the City, and a home that was inhabitable for many months. Now, the HOA is playing chicken to see if we’ll have the money to sue them!
We've been left scrounging every penny to pay for out-of-pocket expenses that our insurance was not able to cover to make our house livable, such as showers. But because of this, we have also had to hold off on other items like heating or air conditioning, which we are still currently living without.
I have a strong six year old daughter who has also been put through all of this & I am very afraid for her & whats to come. We had to couch surf, stay in hotels, homes of family members, and start from scratch.
We hired a great law firm who guided us through mediation, but no one could have prepared us for the HOA’s lack of ownership or negotiation. We have now found ourselves in a tough position. Our HOA is basically bullying us to take them to court, because they know we simply cannot afford the $100,000-$200,00 in legal and court fees it is going to take. They are simply banking on us walking away from this because we don't have the money.
I REFUSE to let our HOA continue to take advantage of us and other homeowners. They are clearly wrong & have not properly been held accountable for their actions in the past . I ask for those who are able to, to PLEASE find it in your hearts to donate whatever is possible to help us get justice & to help us make our home complete again. Thank you!!
