Support Legal Action Against Vax Mandates in VIC

This fundraiser is being run to support the legal costs, expenses and disbursements of the proposed plaintiffs to be represented by NOH Legal in upcoming Supreme Court proceedings in Victoria which will challenge the State Government’s vaccine mandates for workers.  

NOH Legal can confirm that they have been requested to represent the Cetnar's, along with numerous other plaintiffs in proceedings in the Supreme Court of Victoria.  The Cetnars have already commenced their proceeding, being Supreme Court proceeding number S ECI 2021 03569.  It is proposed that additional proceedings be commenced representing plaintiffs from other industries affected by the vaccine mandates.  A team of experienced barristers and medical experts is ready to take the cases head on as soon as possible.

For transparency and accountability, all funds raised will be held in the NOH legal trust account for the use of proceedings in Victoria which will challenge the State Government’s vaccine mandates for workers. All plaintiffs participating in the case who would benefit from donations will be required to sign an irrevocable authority that they will not look to personally claim any balance of funds raised above the required amount, and, that any excess raised at the conclusion of the case should be refunded to the donors in reverse order of receipt until the balance is expired.  As a donor you are supporting the cause as stated above.  However, any donation, large or small, does not allow you to direct or instruct NOH Legal or the barristers as to the manner in which the cases are to be conducted.  NOH Legal and the barristers are ethically bound to represent the interests of the plaintiffs and they are committed to that cause.

 

UPDATE 8/10/2021:

We have received expressions of interest from many people wishing to be plaintiffs from a wide range of industries including construction workers, nurses, teachers, police officers, retail employees, aged care workers, IT employees and other professionals.  Potential plaintiffs are individuals who do not wish to lose their jobs if they don’t comply with vaccine mandates, or, they have complied with vaccine mandates under duress in response to the threat of job loss.  
The proposed budget is intended to cover multiple cases each industry specific and each to be heard together with the other. This will allow for economies of scale to be achieved in terms of expert witness costs, court hearing fees (which are payable for each hearing day), transcript costs, counsel fees and legal costs.


UPDATE 24/10/2021:

As of the 21st October 2021 NOH Legal have filed updated proceedings in the Supreme Court where we will now represent approximately 120 plaintiffs from over a dozen different industries in challenging the Victorian State Government’s vaccine mandates for workers. This challenge will be lead by the highly experienced legal team of Marcus Clarke QC, Dr Jason Harkess and Vanessa Plain.  
 
NOH can confirm that a primary point of difference in this upcoming case will be around arguing a breach of various provisions of the Victorian Charter of Human Rights and Responsibilities and the effect of the Charter on the government imposed vaccination mandates on various authorised workers. NSW does not have a Charter of Human Rights and therefore Charter considerations did not play a part of the judgment handed down by the NSW Supreme Court on 15th October.
