My name is Kerri Rosenblatt and I have been a licensed pharmacist in Oregon for over 31 years. I graduated OSU in 1984 and have lived ever since in the same house in the rural community of Tumalo outside of Bend, Oregon.
My partner Doug Forbes and I opened Tumalo Pharmacy in June of 2011. We provided free healthcare to the small community of Tumalo and we gave the very best service possible to our customers, including free delivery. Tumalo Pharmacy survived largely on insurance payments from our patient’s insurance carriers. They paid horribly and often were unprofitable.
On June 16, 2015, my license to practice pharmacy was suspended immediately at the orders of Gary Miner, Compliance Director. Oregon Board of Pharmacy representatives, without just cause, ordered the immediate closure of Tumalo Pharmacy due to a “Public Safety Health Hazzard” and demanded the door be locked behind them.
We immediately closed the Pharmacy and complied with the request not to operate the store. We implored them for hours to advise us what the emergency, let alone the health hazard was all about. To this day they have still not told us anything or given us anything in writing regarding any emergency or health hazard. We are aware of no broken rules, laws, codes or violations. We are aware of no customer complaints. This was done without “Due Process” and immediately without warning or justification.
The allegations against me and Tumalo Pharmacy are untrue and unsubstantiated and therefore cannot be proven in a court of law or hearing.
I am passionate about fighting for my license and justice because I have worked my entire adult life as a pharmacist and did not deserve the illegal action taken against me. I feel strongly that the Administrative Law Judge will clearly see the fault of the Oregon Board of Pharmacy and that some person or persons has acted beyond the “Color of the Law”.
Now, without the financial help of friends, family, customers and the community it will not be possible to pursue justice in a hearing and disclose the rat behind the scenes that could accomplish this unlawful closure. All my retirement and savings of 31 years went into opening my unique rural pharmacy. When I was ordered to stop doing business it forced the loss of my sole source of income and I was banned from selling off my inventory. It damaged my reputation via hearsay, local and national news, newspapers and countless internet blogs. I lost every customer due to the immediate closure. Without warning or notice it damaged the health of my community.
They still have given no reason and I have received no “Articles of Discovery.” Nothing.
I am raising money to cover legal and other fees involved with pursuing an Administrative Law Hearing to regain my license unencumbered from Oregon Board of Pharmacy and my right to practice Pharmacy in the State of Oregon, my home.
The money will be used to acquire one or more attorneys. A private investigator will be necessary to determine where the corruption lies and to fight this injustice against me and follow this case through a hearing. I need the funds as soon as possible as I must begin to build my defense with the help of a qualified attorney.
We will be relieved if we reach our goal and it means we will have the funds to move forward to an Administrative Law Hearing with a competent attorney on our side. Every donation will be used to build the best legal case possible and will be a huge blessing to our lives and the lives of our families and our community in Tumalo.
It humbles me to ask for financial support but I must save my only livelihood. I have taken a job waiting tables in the meantime but we cannot move forward without help.
