Attorneys, Robert Rush and Brett Phelps, have been fighting since January 2024 to prevent the DEA from adding two research chemicals critical to psychedelic research to Schedule I, the most restricted class of drugs. DOI has been unrestricted for research for over four decades and is referenced in over 900 NIH research studies. During these four decades, there has not been a single medically documented human use of DOI nor any evidence of illicit sales.
In November of 2024, Rush and Phelps conducted the first hearing opposing the scheduling of a psychedelic drug since MDMA in 1985. Rush, representing research scientist Dr. Raul A. Ramos, and Phelps, representing Students For Sensible Drug Policy, presented testimony from many of the world's leading experts in psychedelic chemistry. In DEA headquarters, a six-day hearing occurred, building an incredibly strong body of evidence opposing scheduling.
Despite this, the DEA's Administrative Law Judge, on June 20th, World Psychedelics Day, ruled in favor of adding DOI and DOC to Schedule I. The Judge acknowledged in his ruling that harm to research will occur but found it irrelevant.
Phelps and Rush intend to vigorously challenge the criteria the DEA is using that will harm psychedelic science in the Appeals Court but need your help. They believe there is a strong opportunity to change the law around scheduling drugs. The two attorneys have dedicated hundreds of hours completely pro bono but need your support to continue the fight to save psychedelic research.
