Hello, my name is Daniela. I never imagined having to write something like this, but today I am raising my voice for my father, Jorge, a hardworking and honest man with no criminal record, who was detained by ICE and separated from his family without clear justification.

In Colombia, my parents owned a business on the outskirts of Bogotá. Their lives changed when a dangerous Venezuelan criminal gang, El Tren de Aragua, began extorting and threatening them with death. Living in constant fear, they were forced to leave everything behind. In July 2023, they legally moved to the United States with their children, searching for safety and peace.

They entered the U.S. with valid visas, applied for asylum, and obtained work permits and Social Security numbers. They complied with every requirement and followed the law at all times.

In recent months, my father became seriously ill. He experienced constant pain throughout his body and was forced to stop working. After numerous medical tests, doctors had not yet reached a clear diagnosis, but he was scheduled to begin medical therapy in February.

On January 14th at 7:05 a.m., my father went outside to warm up the car so he could take my mother to work. While sitting inside the vehicle, ICE agents detained him without presenting an arrest warrant or a deportation order.

After this, we consulted multiple immigration attorneys, who explained that, based on the circumstances, his detention did not meet legal requirements, especially considering that he was in the asylum process, had no criminal record, and was fully complying with the law.

That day shattered our family.

When seeking legal guidance, we were presented with extremely difficult options:

- Fight the case, requiring my father to remain detained for months and nearly $20,000 in legal fees and bond.

- Formally challenge the legality of his arrest, a process that could take even longer, with no guarantees of success, while he remained detained and without proper access to medical care.

- Allow him to continue his asylum process but risk being sent to a third country he does not know, such as El Salvador, Guatemala, Peru, or another country, without family, support networks, or any guarantees of safety or medical care.

- Request voluntary departure.

With unbearable physical pain and a broken heart, my father made the most difficult decision of his life: voluntary departure. The pain, uncertainty, and detention made it impossible to continue waiting.

My father has never been alone. He has been married to my mother for 35 years, and they have never been separated. Today, for the first time in his life, he is facing illness, fear, and the return to his country completely alone, far from his wife and from his family, who remain in the United States. We were separated without humanity and without a fair reason. Now we must start over: restart his medical care, find a safe place for him to live, cover medications, and protect his life in a country he was once forced to flee due to criminal threats.

En Colombia, mis padres tenían un negocio a las afueras de Bogotá. Su vida cambió cuando una peligrosa banda criminal venezolana, el Tren de Aragua, comenzó a extorsionarlos y amenazarlos de muerte. Vivían con miedo constante. Para proteger sus vidas, dejaron todo atrás y en julio de 2023 emigraron legalmente a Estados Unidos junto a sus hijos, buscando seguridad y paz.

Entraron con visa, iniciaron su proceso de asilo, y obtuvieron permiso de trabajo y número de Seguro Social. Cumplieron cada requisito y cada cita. Siempre hicieron las cosas conforme a la ley.

En los últimos meses, mi papá comenzó a enfermar gravemente. Sentía dolor constante en todo su cuerpo y tuvo que dejar de trabajar. Después de muchos exámenes, aún no había un diagnóstico claro, pero ya tenía programado iniciar terapias médicas en febrero con la esperanza de mejorar.

El 14 de enero, a las 7:05 de la mañana, mi papá salió a calentar el carro para llevar a mi mamá al trabajo. Mientras esperaba sentado dentro del vehículo, agentes de ICE se lo llevaron sin mostrar una orden de arresto ni una orden de deportación.

Después de este hecho, consultamos con varios abogados de inmigración, quienes nos explicaron que, dadas las circunstancias, su detención no cumplió con los requisitos legales, especialmente considerando que él estaba en proceso de asilo, no tenía antecedentes criminales y estaba cumpliendo con la ley.

Ese día destruyó a nuestra familia.

Al buscar orientación legal, las opciones que nos presentaron fueron extremadamente difíciles:

- Luchar su caso, lo que implicaba que mi papá permaneciera meses detenido y reunir cerca de $20,000 dólares entre abogado y fianza.

- Denunciar formalmente que su arresto no fue legal, un proceso que podría tardar aún más tiempo, sin garantías de un resultado favorable, mientras él continuaba detenido y sin acceso adecuado a atención médica.

- Permitir que continuara con su proceso de asilo, pero con la posibilidad de que fuera enviado a un tercer país que él no conoce, como El Salvador, Guatemala, Perú u otro, sin familia, sin redes de apoyo y sin garantías de seguridad ni atención médica.

- Solicitar salida voluntaria.

Con el cuerpo lleno de dolor y el corazón destrozado, mi papá tomó la decisión más difícil de su vida: la salida voluntaria. El dolor físico, la incertidumbre y la detención hicieron imposible seguir esperando.

Mi papá nunca ha estado solo. Lleva 35 años casado con mi mamá y jamás se han separado. Hoy, por primera vez en su vida, enfrenta la enfermedad, el miedo y el regreso a su país completamente solo, lejos de su esposa y de toda su familia que se encuentran en Estados Unidos. Nos separaron sin humanidad y sin una razón justa. Ahora debemos empezar desde cero: reiniciar su proceso médico, encontrar un lugar seguro donde vivir, cubrir medicamentos y proteger su vida en un país al que tuvo que huir por amenazas criminales.

Estamos recaudando fondos para:

- Medicamentos

- Vivienda temporal

- Gastos básicos y de reubicación
