Urgent Fundraiser to help Jackie pay for Custody Trial
Fellow friends and family,
My friend Jackie is in urgent need of your help. She has been in a highly volatile custody battle since November 2017. Her husband, with support from his very wealthy and influential parents, is attempting to take sole custody of their children. Normally, it would be virtually impossible for a father to succeed in such an attempt, but he has reminded Jackie that, with his parents’ help, he can outspend her.
His strategy has been to bury her with needless legal motions and affidavits that take great time and expense to respond to. He is doing this to ruin her financially, so that she is forced to quit fighting for the right to share custody of their children. To date, he has spent more than $72,000 in legal fees and an undisclosed amount to third parties (private investigators, forensic accountants, and others). Jackie has spent over $50,000 in legal fees to defend herself and fight to be able to remain an active part of her children’s lives.
Jackie depleted her savings and maxed out all her credit cards. She still owes her attorney more than $23,000 for services rendered, and has yet to begin trial. Her inability to pay her mounting legal costs is making it nearly impossible for her to continue the custody battle for her two children ages 6 and 2.
Although the details of this custody trial are not able to be disclosed in detail, it is urgent that we share her story of desperate need for financial help, to pay attorney fees.
Jackie’s current attorney is not able to keep up with the demands of her case, as her husband’s legal team is spending tens of thousands of dollars to drown her in litigation. Jackie is being forced to bring in a new attorney to continue the fight for her children.
In my opinion, there has been an enormous amount of misuse of power and abuse in this litigation. Jackie’s husband is a psychologist. I believe he is abusing his knowledge to falsely accuse Jackie of having a mental illness. He has put her through psychological evaluation and testing. He has told the community she is mentally ill and unstable.
During the past 8 months, police were called to their home multiple times. Every police officer has said to Jackie that her husband’s abuse is apparent—that this is a classic case of domestic violence. Jackie was advised by police officers to go to family court, where the judge followed the police officer’s recommendation and immediately issued her a complete stay away order. Her husband was able to manipulate his way out of it, and have the order lifted to a “refrain from” order.
Jackie has been subject to months of mental and emotional abuse by her husband and his family, in attempts to break her. During this time, Jackie has been:
• Banned from taking her children to visit her family in Canada. In December 2017, Jackie was served with an order that prevented her from going to Canada, with her children, for Christmas. She was told her family could only visit her in the US. Jackie has not been home to visit her family in Toronto for over a year.
• Attacked regularly with affidavits and legal motions making false, unsubstantiated claims. These affidavits and legal motions are intended to drive up her legal costs, as she and her attorney must respond to each one.
• Told that, if she did not move out of her home by June 1st 2018, she would be ordered out of her home. She moved out with a promise of temporary child support. Three weeks after she moved out of the house, her lawyer informed her that the Judge indicated that Jackie’s support may be dramatically reduced. Jackie, a stay-at-home mom, is at risk of not being given child support that was promised as part of her agreement to leave her home.
• Surveilled 24/7 by private investigators, hidden cameras, car trackers, voice recorders, and hacking into her emails and files stored on her iTunes iCloud account.
Furthermore, virtually anywhere Jackie goes, within weeks, that person or place is served with a subpoena for records regarding her transactions and activities. Her husband harasses and attacks her all hours of the day, either with court orders, personal attacks, or by people paid to stalk her.
After serving her with divorce papers, Jackie’s husband closed the business that Jackie ran, the Wave Center, so she lost her primary means of earning an income. She is with her children each day and limited in the hours she has available to secure another job. Without the support she was promised, Jackie may be unable to afford to stay in the US and continue to be a parent to her two sons.
Of equal concern, without financial help, Jackie will not be able to take this case to trial. Jackie needs your help for attorney fees to fight for shared custody of her two boys. To finish this custody litigation, Jackie’s new attorney is asking for a retainer of $20,000 to pick up her case. The sooner she raises the money, the sooner she will have representation and the better prepared her attorney will be for trial. On Jackie’s behalf, I am asking for your help today.
