I am the victim of lawfare and government weaponization from the Biden DOJ. My name is Dr. Ron Elfenbein, and I am an emergency room physician. I have dedicated my life to serving my community, especially during the COVID pandemic, when I worked tirelessly to help my patients and neighbors. I donated large amounts of personal protective equipment and supplies when they were needed most, including to the DEA, who asked me for help when they could not get PPE to complete a mission. My efforts were recognized with a personal citation from our Governor, a citation from our state legislature, and I was honored as Person of the Year by our state medical society. I have always tried to do what’s right for my community, even when it meant speaking out on important issues. I also went on Fox News and called out the Biden administration for a very big mistake that was going to kill people who depended on the monoclonal antibodies. Four months after speaking out, and without warning, I was indicted on healthcare fraud charges. The government accused me of 'upcoding' without first reviewing the medical charts upon which all the coding is based. I believe these charges are the result of government overreach and lawfare, and I am now facing a legal battle that I never expected. The stress and uncertainty have been overwhelming for me and my family. Despite everything, I was determined to fight these charges and clear my name.
After a difficult trial, the Chief Judge of Maryland, Judge James Bredar, who sat through the entire proceedings, acquitted me in a detailed 90+ page opinion. He stated, among other things: "Not only is there insufficient evidence to prove that the Defendant's reading was unreasonable, but there was evidence that affirmatively supports defendant's understanding of the coding requirements. There is simply not sufficient evidence that the Defendant's reading of the CPT manual was not in compliance with the coding requirements such that a reasonable jury could find falsity beyond a reasonable doubt." He concluded, "There can, of course, be no crimes if the Defendant complied with those rules."
Unfortunately, the Biden DOJ appealed the decision, and the Fourth Circuit Court overturned the acquittal, ordering a new trial. We believe the appellate court made several factual and legal errors in their opinion, but now I am facing the prospect of another trial in August. The first trial essentially bankrupted us, and now we are struggling to afford the costs of defending myself again.
The legal fees are still mounting quickly, and the loss of income has made it even harder to keep up. I am reaching out for help because I cannot do this alone.
