Stop the State of Texas From Taking Your Copyright



Dear Friends:

I have known most of you for many years. We have shared many great memorable times together.

I am now in a lawsuit against the University of Houston and the State of Texas for their theft of my photo of downtown Houston, which I call “Cityscape" (see above).

The University of Houston used this photo on four different website pages and in an advertising promotion with Forbes magazine to promote UH’s Bauer Business School.

UH stole this photo for their promotional use and never paid a licensing fee to use this photo. When I approached them to pay a licensing fee they refused and are now trying to use a defense of sovereign immunity to keep from having to pay for what they stole.

This is an expensive legal fight to preserve IP rights.

State actors stealing intellectual property is a big problem in Texas. Since 2016—a total of 17 lawsuits have been filed against Texas universities and state agencies for stealing intellectual property.

In the first round of this lawsuit, the 295th District Court in Houston ruled against the University of Houston’s claim of sovereign Immunity. This case is now in the Texas First District Court of Appeals.
