Stop MCRR Cell phone tower at RCVFD

A group of Mores Creek Rim Ranches homeowners are looking for financial support to fight the approved proposal for RCVFD to place a cell phone tower in our community. There is an appeals process but we need all of your help to get the appeal in front of the Commissioners in Boise Country in November.

The Planning and Zoning board in review of the CUP application CUP #2021-006 Horizon Tower, LLC gave approval without consideration of many items that were discussed with all the 30+ people present at the hearing and approved the tower without many consideration which they are supposed to provide before making a decision. 

This did not happen and is conflict of their own application process and providing the community with answers:

OUR CONCLUSION: 

- Proposed use is highly incompatible with specific rural residential neighborhood
- Proposed use produces significant negative impacts
- Application had Conclusory statements without support

- Not worse than power poles
- Not noisy
- No impact to natural environment
- Power pole would actually help wildlife
- Significant applicant burden

OUR UNDERSTANDING AND BOISE COUNTY PROCESS/ EVALUATION 

“Every use that requires a CUP shall be subject to review and appraisal
by the Commission to determine whether or not the use would cause any
damage, hazard, or nuisance or other detriment to persons, property, or
natural resources.” Boise County Zoning Code Section 4.3

CUP applications must deal in details

Applicant must provide sufficient evidence and the local government
produces decision with “reasoned statement” explaining basis to meet
Idaho Code 67-6535

Requirement: use must be harmonious and not
in conflict with surrounding area

- Mere feet from home
- Significant rural residential neighborhood with minimal commercial use
- Overwhelming change to landscape and surroundings
- Far higher than power poles

Application does not address specific surrounding area

- Diversions regarding inability to find other sites
- Irrelevant to applicant’s burden to show use fits with specific desired area
- Property values
- Case law regarding view
- Rural neighborhoods’ general need for communication
- Applicant needs to show why 150-foot power pole fits with the specific proposed rural
residential neighborhood

We are looking for people to share our story and help us in the fight to keep our local elected officials accountable to the voting constituents and keep them honest with regards to the Boise County Plan.
