Stop Cancer Patient's Eviction

Betty Ann Grund faces imminent eviction for nonpayment of rent.

Betty Ann is a 79 year old cancer patient, currently being treated for terminal stage 4 luminal breast cancer with lung and bone metastases. In July 2016, Betty Ann was first diagnosed with cancer.  After an initial round of treatment, she received the bad news, in March, 2017, that the cancer had spread.

Unable to work due to her condition, Betty Ann has struggled from treatment to treatment, and has fallen behind in her payment of rent.

When I first met Betty Ann, she had already been to court, had already agreed to pay her rent by a certain date, and had consented to a judgment in her landlord’s favor.  Unable to obtain the funds she agreed to pay, Betty Ann found herself facing an eviction in September, 2017. Betty Ann attempted to get an extension, but was denied by the court. Betty Ann was then referred to my office.

Betty Ann walked into my office with a notice of eviction in hand from a New York City Marshal. I took the case Pro-Bono, and was able to have the court extend the time for Betty Ann to pay until the end of November.  Unfortunately, anticipated help did not come through, and I was forced to again stop an eviction in December, getting the court to give Betty Ann through December, 2017 to pay.

Betty Ann has been unable to obtain any assistance and now faces eviction on January 23, 2018.

Betty Ann Grund, a 79 year old woman suffering from terminal cancer, is now facing being evicted with no place to go. 

If Betty Ann is able to raise the full amount of her rental arrears, approximately $32,000, the nonpayment case will be dismissed and Betty Ann can live out her remaining days with dignity.  If Betty Ann is able to raise a portion of that, I will go to court on Monday and ask the court to force the landlord to accept partial payment and extend the time for Betty Ann to pay the balance.

Without payment being made, the court cannot be expected to stop an eviction indefinitely. I was able to buy Betty Ann four additional months, but without payment to the landlord, do not expect any additional extensions. 

This is a last ditch effort to use social media for a worthy cause. If 1,600 people donate $20 each, Betty Ann will be able to rid herself of the stress of an eviction case so that she can focus on her treatments. 

As attorney, I have worked on this case Pro-Bono. Be assured that no funds from this GoFundMe campaign will be used to pay any legal fees nor will they go to me in any way. All funds from this campaign will solely go towards Betty Ann's landlord as payment of rental arrears. (And to GoFundMe (5%) for their fee to run these campaigns)
