Hi, my name is Kirk Sutherland. I'm a member and shareholder of City Cabs - V121. I'm also a Chartered Certified Accountant by profession.
I recently helped organise an EGM requisition notice that was signed by nearly 40 members of City Cabs and delivered to Atholl Place, in line with our rights under the Companies Act 2006.
Since then, around 15 members — either known to have signed the requisition or thought to be supportive — have received formal letters from the committee raising disciplinary concerns. These letters appear to be linked to an unofficial Facebook group and cite Article 5 of the company rules (ejection from the company).
The timing, tone, and nature of the letters have caused serious concern — not just for those directly affected, but for many other members who value fairness and transparency.
As members, we believe strongly in the right to raise concerns, engage with each other, and participate in the democratic governance of our company. We are therefore raising funds to:
- Seek professional legal advice on how best to respond
- Ensure that any disciplinary process is fair, evidence-based, and impartial
- Defend our rights to communicate, question, and participate as members
- Support those who may be unable to afford legal representation alone
To ensure full transparency and avoid any confusion, we will be asking our solicitors to hold the funds in a regulated client account, where they will be kept securely and separately from any personal or campaign organiser accounts. This allows legal costs to be paid directly and ensures that any surplus can be handled fairly and professionally — whether that means holding it for future member protections or returning it to donors where possible. This approach gives everyone peace of mind that the money is being managed properly, with clear oversight and accountability.
If a client account isn’t possible, the funds will instead be transferred to a dedicated bank account opened specifically for this legal fund. This account will be used solely for legal advice and member protection costs.
Any surplus will be dealt with transparently — either held for future member protections or refunded where possible to donors who have shared their contact details.
While a solicitor-managed client account is our preferred option, this fallback still ensures your donation is kept separate from personal use, with clear oversight and transparency.
We understand that some members may have wished to support the EGM notice but felt unable to, or feared possible repercussions. If you’d like to contribute to this cause anonymously, your support would still mean a great deal.
