UPDATE: A Major Victory—But the Fight Isn't Over

Six weeks ago, I asked for your support after my arrest while defending my inherited ancestral land rights passed down through my third great-grandfather, Charles A. Labuzan Sr. Because of your prayers, encouragement, and financial support, we've reached an important milestone in this four-year legal battle.

Today, I'm grateful to share what has been the most significant legal victory in my case to date.

In my second federal lawsuit against the U.S. Army Corps of Engineers, United States District Judge Robert P. Chamberlin denied the government's Motion to Dismiss and its alternative Motion for Summary Judgment.

This ruling allows my case to move forward into the next phase of litigation. For the first time, the defendants must respond to my claims through the discovery process, giving me the opportunity to obtain evidence and present facts that I have not previously been able to fully develop before the Court.

While this is a tremendous victory, the fight is far from over.

The Court has now entered a Case Management Order establishing deadlines that require me to gather professional evidence to support my claims. My expert designation deadline is October 16, 2026, and meeting that deadline requires resources that are well beyond what I can accomplish alone.

To prepare my case, I must retain qualified experts, including:

A licensed land surveyor

A qualified real estate appraiser

A professional photographer and/or mapping specialist

The land inspection will document critical evidence, including:

Property boundaries

Survey monuments

Fences, gates, and signage

Roads and access points

Visible structures

Current surface use

The relationship between the occupied land and the property's legal description

This documentation will help create an objective record as my case progresses through discovery and toward trial.

In addition to these expert costs, I continue to face legal support expenses, court filing fees, travel costs, document preparation, copying and records expenses, and other litigation-related costs necessary to move this case forward.
