en// Solidarity with the People of Intag, Solidarity with Nature
Mining companies have wanted to get their hands on the raw materials beneath the lush cloud forest in Ecuador's Intag region for two decades. This would have serious consequences for nature and the population. Dozens of species of animals and plants in danger of extinction will be impacted by this copper mining project, as well at least four communities. Intag residents have formed a strong and defiant civil society. Currently, the affected communities are fighting against the copper mining project Llurimagua and thus for the rights of nature and clean drinking water. Four Intag residents supported by human rights and environmental organizations have filed lawsuits against the Ministry of Environment, Water and Ecological Change, the Ministry of Energy and Non-Renewable Resources and the Attorney General's Office. The right for communities to be consulted and the right of nature are the two main focuses of the legal challenge. If Intag wins this case, it will set a legal precedent for the rest of the country and will be vital to protect water sources, endangered species and communities' collective rights. The court proceedings dragged on. Several people from the affected communities of Intag invested a full 10 days to testify in court. The case was dismissed in the first instance. The plaintiffs are not discouraged by this and are appealing. A new trial is about to begin. For the people who take part in the protracted court process, this means that they have to put up with repeated loss of earnings. There is no state aid for such a situation in Ecuador.
For whom?
The most affected people are four plaintiffs and four witnesses. They could not cultivate their land or take care of their livestock during and before the court days. In addition, they lack the financial means to pay temporary workers.
One day of work translates into a salary of 25 USD. With 12 days of lost earnings (hearing and preparation), we are talking about a loss of 300 USD per person for the past court case, which amounts to a total of 2,400 USD for eight affected persons. In addition, the 4 plaintiffs are also expected to lose earnings in the upcoming appeal proceedings (at least 4 days of preparation for the appeal proceedings). The court dates have not yet been taken into account.
What happens with the money?
The money will be made available to the plaintiffs and the witnesses in order to compensate for their loss of earnings and, if necessary, to pay temporary workers. The use of the money is controlled by the Intag-based NGO Decoin , which is headed by Carlos Zorrila.

Who and What is behind Intag e.V.?
Intag e.V. supports the autonomous and sustainable development of the Intag region. The courage and the will of the population to stand up for the preservation of the environment and the rights of future generations have impressed us deeply when we have been there ourselves in different years. The planned open copper mine there is not justifiable and we want to contribute to keeping Intag, one of the most biodiverse regions in the world, green and without a mine. Therefore we support the work of different grassroots organizations in Intag.
This work is of course only possible on the basis of a very good cooperation with the local people in Intag.

Bergbauunternehmen wollen seit fast drei Jahrzehnten an die Rohstoffe, die unter dem üppigen Nebelwald in der ecuadorianischen Region Intag liegen. Dies hätte gravierende Folgen für Natur und Bevölkerung. Bewohner:innen von Intag haben eine starke und wehrhafte Zivilgesellschaft gebildet. Aktuell kämpfen die betroffenen Gemeinden gegen das Kupferbergbauprojekt Llurimagua und damit für den Erhalt einer der artenreichsten Regionen der Erde. Durch den Schutz der Natur würden nicht nur zahlreiche Arten vom Aussterben geschützt werden, sondern auch die Lebensgrundlage der Bewohner:innen der landwirtschaftlich geprägten Region Intag sichern: sauberes Wasser und fruchtbare Böden. Auch sind mindestens vier Dörfer von diesem Projekt betroffen.
Das in der ecuadorianischen Verfassung verankerte Recht zur Umweltkonsultation sowie die in der Verfassung verankerten Rechte der Natur wurden und werden in Intag immer wieder missachtet. Unterstützt von mehreren Menschenrechts- und Naturschutzorganisationen verklagten Anfang des Jahres die betroffenen Gemeinden Intags die zuständigen Ministerien und ein Bergbauunternehmen (Empresa Minera Exploraciones Mineras Andinas del Ecuador S.A.), welches eine Tochtergesellschaft der staatlichen Bergbaufirma CODELCO aus Chile ist.
Das Gerichtsverfahren zog sich in die Länge. Mehrere Personen aus den betroffenen Gemeinden Intags investierten volle 10 Tage, um vor Gericht aussagen zu können. Ihr Einsatz wurde leider nicht belohnt: Die Klage wurde in erster Instanz abgewiesen.
Die Kläger:innen lassen sich dadurch jedoch nicht entmutigen und gehen für ihre eigenen in der Verfassung verankerten Rechte und denen der Natur in Revision. Ein neuer Gerichtsprozess beginnt. Das bedeutet für die Menschen, die am langwierigen Gerichtsprozess teilnehmen, dass sie wiederholt Verdienstausfälle in Kauf nehmen müssen. Staatliche Hilfen für eine solche Situation gibt es in Ecuador nicht.
Sollten die Bewohner Intag´s diesen Fall jedoch gewinnen, wird dies einen Präzedenzfall für den Rest des Landes schaffen und von entscheidender Bedeutung sein, um Wasserquellen, gefährdete Arten und die kollektiven Rechte der Gemeinschaften zu schützen!
Für wen?
Am stärksten betroffen sind vier Kläger:innen und vier Zeug:innen. Sie konnten während und vor den Gerichtstagen nicht ihr Land bewirtschaften und sich nicht um ihr Vieh kümmern. Darüber hinaus fehlen die finanziellen Mittel, um Aushilfen zu bezahlen.
Für einen Tag Arbeit wird ein Gehalt von 25 USD angenommen. Bei 12 Tagen Verdienstausfall (Anhörung und Vorbereitung) sprechen wir für das vergangene Gerichtsverfahren von einem Verlust i.H.v. 300 USD pro Person, was sich bei acht betroffenen Personen insgesamt auf 2.400 USD beläuft. Darüber hinaus wird für das anstehende Revisionsverfahren ebenso mit Verdienstausfällen der 4 Kläger:innen gerechnet (mind. 4 Tage Vorbereitung zum Berufungsverfahren). Die Termine vor Gericht sind hierbei noch nicht berücksichtigt.

Was passiert mit dem Geld?
Das Geld wird den Kläger:innen und den Zeug:innen zur Verfügung gestellt, um so die Verdienstausfälle zu kompensieren und ggf. Aushilfen zu bezahlen. Die Verwendung der Gelder wird über die im Intag ansässige NGO Decoin , welche von Carlos Zorrilla geleitet wird, gesteuert.

Wer und was steht hinter dem Intag e.V.?
Der Intag e.V. unterstützt die selbstbestimmte und nachhaltige Entwicklung der Region Intag. Der Mut und der Wille der Bevölkerung, sich für den Erhalt der Umwelt und die Rechte kommender Generationen einzusetzen, haben uns tief beeindruckt, als wir in verschiedenen Jahren selbst vor Ort waren. Die geplante offene Kupfermine ist dort nicht zu verantworten und wir wollen dazu beitragen, dass Intag, eine der artenreichsten Regionen der Welt, grün und ohne Mine bleibt. Daher fördern wir die Arbeit verschiedener Basisorganisationen in Intag.
Diese Arbeit ist selbstverständlich nur auf Basis einer sehr guten Zusammenarbeit mit den Menschen vor Ort im Intag möglich.
