Lawsuit to Protect Small-town Charm of Chester, Connecticut

On November 20, 2023, Chester’s Planning & Zoning Commission approved Honeycomb Real Estate Partners and Vesta’s joint application for thirty-six affordable housing units at 47 Middlesex Avenue. Abutters, residents, and expert witnesses identified numerous health and safety concerns with the proposal that were presented to the commission during sixteen hours of public testimony. Seven abutters filed an appeal in December as we feel that the commission acted arbitrarily and did not address the following concerns in their decision:
  • Adverse impacts on groundwater and well water quality
  • Increased risk of flooding due to water runoff volume
  • Lack of erosion plan that complies with state regulations
  • Unsafe sanitary sewer connection
  • Lack of adequate access for emergency vehicles
  • Lack of baseline and periodic testing thereafter of abutters’ wells
  • Lack of adequate parking, needed pedestrian crossings, and traffic flow control
