I am a new comer in Canada, a Single mother of 4 who is a victim of fraud/ negligence of professional or breach of contract what to say I don't know. I bought a house by working 7 days a week put all my savings in down-payment and Realtor and his father Unlicensed realtor induced me to take decision onspot and home inspector whom I hired by a know person reference didn't checked house properly. Realtor said me he will check the home inspection report because I said realtor I don't know how to check report so realtor said don't worry I will check it and let you know if anything is required. Later when I asked realtor why home inspector wrote for upper floor bedroom mold specialist should check and why roof disclosure needed is written he said no there are certain way to write inspection report so don't worry its a standard way of writing report and also said for old homes they have to write like this. I again asked do I need further inspection from any specialist he said No everything is good don't worry I checked the report.
Damages which they showed me and said it will cost around $2000 for fixing. I asked if roof is good any damage they said its good when I asked when it was changed he said 13 years before but roof is hail damage which was hidden from me. There is mold in basement and kitchen and major leakage in basement and also possible leakage on upper floor bathroom. I purchased house on 1st of June and on 7th june I saw mold in house.
The house was occupied by tenants and realtor said me I have to assume tenants because its Alberta law I have to give 3 months notice so I cannot ask them to leave before 3 months and realtor wrote lease agreement for me and tenants. When I went to lawyer to sign the document my realtor was with me which I came to know later he is not suppose to be with me to see the lawyer.
Then I went for another inspection suggested by my manager which showed me many more damages in house.I asked contractor to check and give estimate they said approximately $50000 it will cost but it can go higher as mold is how much spread they cannot say and basement has to be ripped off atleast 4 feets high and it can go higher also depends how much mold is spread.
I don't have money to repair the house because I am paying mortgage and have to support myself and my children. I have medical condition for which mold is very harmful and also my son is having medical conditions Uveitis and because of medical conditions I clearly said realtor that I don't want house with mold, grow up or leakage.
I approached a lot of law firms no one takes case without upfront money $5000 upfront they ask and said it can go very high because these case take time and they charge hourly once $5000 is finished then again I have to pay upfront to continue .
I took an old house for $260,000 but the house is not that worth because it is too much damaged.
Help me to go to court and fight for my rights and help me to repair the house because if I don't repair it, it will be more damaged and I cannot stay in this house like this where mushrooms are growing.
