Help Charlotte Kirk fight sexual harassment

Charlotte Kirk is a survivor of sexual abuse by multiple perpetrators over the last 10 years. Diagnosed on the Autism spectrum, Charlotte fell prey to the first of several powerful and corrupt men when she was just 19 years old. Now 29, she is a crusader for survivors’ rights to speak out and tell their stories. 



 
Charlotte is locked in a complex legal battle with a cabal of some of the wealthiest and most powerful men in Hollywood who have sued her to cover up their shameful conduct. Charlotte is fighting to obtain a ruling on two statutes – CCP sections 1001 and 1002 – which are intended to prohibit so-called “secret settlements” that include non-disclosure agreements in California, thereby preventing abusers from hopscotching from victim to victim, undetected, often for years, by coercing their victims to settle their claims with no right to speak out about their suffering or trauma to anyone. Allowing NDAs in these settlement agreements perpetuates stigma and protects offenders, not just in Hollywood but across all industries. If you thought sexual harassment in the workplace ended with Harvey Weinstein’s arrest, think again.

Charlotte’s opponents seek to narrow the interpretation of these statutes so as to render them toothless, and we simply cannot allow that to happen. We have to fight for victims’ rights just as hard as the abusers are fighting to deny those rights.




Charlotte has been fighting this legal battle on multiple fronts, in both arbitration and the courts, for over 2 years, and it’s taken both an emotional and physical toll.  Legal battles are painfully drawn out, often intense and stressful, and lawyers are expensive.

She now needs your help to carry on the fight. Otherwise, these perpetrators could win, not because they are right, but because they have deep pockets. We desperately need to raise funds to pay her lawyers so that they may continue their good and valuable work of defending this important law.

This isn't just a Hollywood problem; it affects every business and industry through the country. California’s #metoo laws are a model for all states, and the decision in this case will have ramifications for comparable laws that have been or will be passed throughout the U.S.

In simpler terms, this is a huge deal. It’s about protecting our daughters, sisters, mothers and anyone else who might be at risk from sexual harassment and abuse.




This is a true David vs Goliath story. There was only one Harvey Weinstein against multiple victims. In this struggle there is just Charlotte, alone, against several millionaires and even one billionaire, some of whom have already been accused of sexual harassment and abuse. They have already used their power and influence to publish false and scurrilous stories about Charlotte in the press in order to twist the narrative in their favour by attacking her credibility and reputation.  With the NDA preventing her from defending herself, Charlotte has remained dignified and silent, preferring to vindicate herself before a judge that she may tell her own story in her own way.




So, why should you help?  Because the cause she’s fighting for is incredibly important, not just for Charlotte, but for all victims of sexual misconduct and abuse. CCP 1001 and 1002 have never been tested in a California court before. If the court rules in Charlotte’s favour, this will change things for all survivors, past and present, and help prevent future abuse by effectively outlawing NDA's in secret settlement forever.  Perpetrators will be stopped in their tracks and survivors will have the freedom to speak out.  But if Charlotte is unable to continue the fight, it will render the #metoo movement virtually irrelevant as predators will be at liberty to continue their behaviour with impunity under the shield of NDAs.
