The fate of Divinity Hill still hangs in the balance. The former Colgate Rochester Divinity School has been sold but our efforts are continuing!
Here's an update:
First, we want to offer heartfelt thanks to you, for being among the overwhelming majority of 1,367 neighbors who signed our petition about the development! As you probably know, the City nevertheless ruled against us, 5 – 3, and developer Angelo Ingrassia purchased the property in September.
His plan would involve the removal of over 100 trees on a delicate sandy ridge, to erect two 52 unit apartment buildings that would tower 100 feet above the surrounding neighborhood, and add at least 200 cars coming and going out of that one driveway onto Goodman St. Not to mention the new light and noise pollution.
If any development needs an Environmental Impact Study, this one does. Yet the City did not require it.
So we--a smallish group of 15 households, representing all who signed our petition--hired an environmental attorney, and sued the developer and the City, asking for that Environmental Study to be required. Our case was heard in January, and we expect the judge's decision in the coming weeks. We will email you updates: the judge’s decision, and if needed, a possible neighborhood meeting to strategize.
We have a new GoFundMe to help raise money to cover the remaining legal fees. Our neighborhood already raised over $15,000 last fall to begin the lawsuit (heartfelt thanks if you contributed!), and after additional contributions in January through early April (via GoFundMe or direct payment to The Zoghlin Group), there remains another $19,986 to raise. Those of us who have signed on to the lawsuit are of course the ones legally responsible for the bills that have accumulated. But would you be willing to join with your neighbors to support this cause? Considering the significant size of our outstanding obligations, any amount will be welcome and most appreciated!
