We are a group of community members who consider Thomas Jack Memorial Park to be an INAPPROPRIATE location for the proposed Dalby Cultural Centre.
Western Downs Regional Council have 10,000 Sq M of land 1200 metres to the east of the Park, which for many decades previously, housed a Cinema, Art Centre and Library, yet WDRC elect to destroy a portion of a 36680 Sq M of beautiful park land at a time when parks around the world are being loved and cherished.
In the event Council approve the development application for the Dalby Community Centre, we are planning to commence legal proceedings in the Planning and Environment Court, and in doing so, we will seek to have the Court declare that the development application should have undertaken more public notification and as it did not do so, the development approval is invalid. WDRC also completely ignored a petition with 4635 signatures against building in Thomas Jack Memorial Park.
The group will further allege that Council has not taken the required actions to enable the Dalby Cultural Centre to be established on reserve land. Legal proceedings may be costly. From advice received we estimate that between A$30,000 - A$50,000 will be required.
If required, The Save Thomas Jack Memorial Park group will use MINIMAL funds in a fully transparent format for legal and other costs, that are over and above the Planning and Environment Court, to arrive at a successful positive outcome to save Thomas Jack Memorial Park from environmental vandalism by the Western Downs Regional Council.
In the event the group does not commence legal proceedings, and construction does not go ahead the donations received will be donated to projects in Thomas Jack Memorial Park or Bush Heritage Australia, an Australian charity who actively work with communities and government to purchase and manage reserve land all around Australia, or a like charity.
