Save a child from a child abuser

Donation protected

In November of 2017 in Minot ND, my son Dylan was attacked by his abusive mother, Amanda. There has been physical and emotional abuse his entire life, and despite reports to social services, nothing was done until this last time. She nearly choked him to death, and was finally charged with felony child abuse. Part of the bail agreement was a no contact order with Dylan until Amanda completed services through Social Services.

Because I live down in Denver, social services and the police immediately put Dylan into foster care until I could get him. Despite the charges against her, his mother still had legal custody and had the right to fight me taking Dylan out of foster care...and that's exactly what she did. For nearly 2 months I fought my way through the system and finally got emergency order for 6 months of physical custody of him in January of 2018.

The 6 months is nearly up, and Amanda has completed all of her recommended services, but she is still very unfit to be a mother. The phone contact she has had with Dylan has been filled with constant emotional abuse. I even drove Dylan back to Minot for the 4th of July to see friends and family, and his mother refused to let him see his brother and sister, whom he loves very much.

So why is she still continuing to abuse and manipulate him? Because she is refusing to take responsibility for choking him, and is taking the case to trial. Dylan is going to be forced to testify against his mom, reliving the abuse. His mom is mad that he has to testify against her and that he wants to stay living with me.

Amanda goes to trial August 14th of 2018. Here is the biggest problem. The temporary custody order is ending very soon. There is a review hearing scheduled for July 18th. The prosecutors have told me they don't have a valid legal reason to ask for an extension on the emergency custody order that i have, despite the fact that Dylan would be put back into a house with his abuser, whom he is going to have to testify against not even a month later.

I can't afford a lawyer. I paid a company to draw up a motion for me to get full physical custody and I've filed it, but that will take months to complete still. From what the prosecutors told me, my only option is to get an Interim Order. That would basically give me another 60 to 90 days of custody, and save him from having to live with his abuser and the person he is going to be testifying against.

He came down here to Denver with basically nothing. After buying him everything for his room and himself, and paying for counseling, I am out of money. If I can raise enough to simply pay a lawyer to fully take on the case and save my son, that would be ideal. However if I can even raise enough to get a lawyer to file the Interim Order, it should give me enough time to get a judgement on the custody I requested.
