RISE Delaware Round 2: Legal and Other Costs

RISE Delaware is continuing our hard-fought legal fight to keep Delaware from foisting

Medicare Advantage (aka Medicare Disadvantage) on State Retirees. The administration

thought old folks were an easy target to push around. But we are not! And, current employees are now understanding the risk to their promised retirement healthcare benefit and becoming involved.

HERE IS WHERE WE ARE:

With your generous help, we raised money to start litigation in the Delaware Superior Court on

September 25, 2022, to fight the State. And on October 19, 2022, we obtained a “Stay Order”

with a temporary injunction against the State from implementing a Medicare Advantage plan!

The order was based on the State’s abysmal failure to follow Delaware’s statutorily-mandated

open government safeguards when adopting Medicare Advantage. That injunction—which the

State of Delaware never sought to have the Court lift—is still in place.

The State has now appealed the Stay Order and challenged its holding that it violated open

government laws. RISE filed its opening brief on appeal on September 6, 2023, and we invite you to read it from the RISE website.

Had we not won that stay, Medicare Advantage would be a done deal. Looking back, it was an

amazing feat short of a miracle given how the State hamstrung us. A true Delaware version of

David versus Goliath! And we were able to do this only because of your financial and other

support. Volunteers have helped by putting in enormous amounts of time.

However, we have never raised enough money to come close to compensating the lawyers in

the Superior Court for their time in achieving the amazing victory.

WHAT WE NEED:

We need money to pay our exceptional lawyers who achieved the victory in the Superior Court.

We still owe them about $225,000 (as of September 6, 2023). We currently have money in the

bank to support our effort in the Delaware Supreme Court in opposition to the State.

We also need a small amount of money for ongoing administrative costs for RISE, such as our

website and email service.
