UPDATE STATUS LOCAL RESIDENTS FILE LAWSUIT AGAINST ST. LUCIE COUNTY’S RECENT SITE APPROVAL FOR A 220 BED FACILITY ON SOUTH HUTCHINSON ISLAND A long overdue update on this legal case… 2020 has been a long year for all of us. So much has been delayed due to Covid19; including the court system. Make no mistake though…this case is alive. In September, 2020, the Court ruled against the County’s motion for summary judgment. The County had requested that the Court throw out the entire case. In response, the Court ruled that the zoning change from residential development to a planned non-residential development to accommodate a 220-bed rehabilitation hospital remained a genuine issue of material fact. In addition, the Court ruled that there were questions regarding whether the wetland waiver granted by the County was consistent with our County’s Comprehensive Plan policies. This is great news. The attorneys representing us over the past year have been fantastic; thorough and also very fair in their billing for this case. The current timeline has this case returning to Court in January, 2021 to argue the above two issues. Now is the time to not give up. We need additional monetary support. No amount is too small.
