 In September 2010, Nicole Krycki was forced to request that her husband leave the family home because of domestic violence she endured along with his ongoing illicit drug use and criminal activities. In his anger and outbursts for being asked to leave, Nicole’s husband continuously threatened to make false claims to CAS (Children’s Aid Society) in order to cause her to lose custody of their youngest child and Nicole’s pride and joy, Dominic John-Michael. Nicole has sole custody of her oldest 3 children since 1999 and her youngest son Dominic was almost 18 months old at the time.

 Fearing that her husband would follow through with his threats, Nicole applied for sole custody of Dominic on his 2nd Birthday being April 20th, 2011 . In response, both Nicole’s husband and his mother made false claims and malicious accusations to CAS.  A CAS worker attended Nicole’s home unexpectedly on numerous occasions and clearly documented in his notes that the home was very clean and the children (Dominic and his three teenaged siblings) were all healthy and happy. When the false claims continued, Nicole was advised by a CAS worker to take Dominic and go stay at a women’s shelter, he strongly urged Nicole to do this to allow professionals to document her parenting skills. Nicole complied with this request.

 Three weeks later the same social worker called the Women In Crisis shelter and demanded Nicole to attend a meeting at the CAS Head Office Boardroom, on September 17, 2012. The meeting turned out to be an ambush, during which the CAS forcefully removed Dominic from Nicole’s custody with no warning. The CAS workers attempted to force Nicole to sign documents stating that she agreed to Dominic’s apprehension, which she refused to sign. Dominic was assigned an OCL (Office of the Children’s Lawyer) to represent his “best interests”, and from that moment on, Nicole lost all rights to her son.

 Nicole readily complied with everything that was asked of her during that time. She had doctors and psychiatrists document everything about her parenting and mental health.  Nicole attended her family doctor on a regular basis to be cleared of drug use accusations, mental health accusations.  Nicole paid for private councilling, completed a voluntary parenting course (in which she passed with honors at 98%)  These doctors were completely astounded by the injustice of the events that led up to Dominic’s removal from Nicole’s custody.   These doctors and specialists even attended the trial free of charge to demand that Dominic should be returned immediately.  The doctors prepared, authored  documention and presented letters to the courts, sworn affidavits, clearing stating that Dominic should be returned home to Nicole and his siblings forthwith.  

 Because of the false allegations made by Dominic’s father and grandmother, the CAS appointed an OCL who was clearly biased from the very beginning and recommended that Nicole never be allowed to see her son without supervision again. The only “witness” for the father and grandmother was the CAS worker. The verdict was a travesty of injustice.

After the trial, Nicole was contacted by numerous lawyers who offered to represent her in a civil law suit against CAS and OCL.  However, CAS advised Nicole that if she proceeded to a contingency lawyer, she would never see her son again.

 Dominic has since been living with his paternal grandmother. Dominic’s father has recently served jail time for another case of domestic violence involving his girlfriend. The grandmother won sole custody on January 15th, 2015.  On January 17th, 2015 Dominics father was charged with 2 counts of assault and public mischief whereas Dominics grandmother posted his bail bond and was furthermore approved to be his surity.  This is NOT in the Best Interest of the Child. The father also has a  previous criminal record.  In August of 2012 CAS paid for "hair follicle, urine and blood testings for illicit drug use" he and Nicole were both tested and screened, Nicole passed and he failed. Nicole has never used illicit drugs and has no criminal record, yet she has lost all rights to her son, and Dominic’s  father who is a self proclaimed drug addict and convicted of numerous criminal acts is allowed to share a bedroom with Dominic. It has now been 2.5 years since Nicole lost status quo primary custody of Dominic.

Nicole shares:

“Dominic was born on April 20, 2009. He was 10 lbs 1 oz. I had primary status quo custody of him and spent every moment teaching him, exploring nature with him and loving him until September 17, 2012. That day, my world became my shamed existence. I have lost so many milestones to share with Dominic. I missed his last two Christmas', his first day of school, his last two birthdays… all of his other special occasions like Easter, Thanksgivings, Christmas pageants, soccer games…”

In the reasons for the Honourable Justice verdict, it clearly stated "the society (CAS) and the OCL have mishandled this case from the onset"  It further mentions that the clinicial investigator was found guilty by omissions, and did not follow up with any of the expert opinions and/or collaterals.

Neither the CAS or the OCL or the Clinicial Investigator have spoken to or interviewed Nicole, Dominic's 3 siblings, or the father SINCE the illegal seizure of Dominic in late September 2012.

 Nicole has fought passionately for Dominic's return home to no avail. She is now facing her final opportunity to appeal the court’s decision.  Upon receiving the verdict Nicole was ordered to only see Dominic ONCE per month for 2 hours at a supervised facility.  Nicole had to meet the crucial deadlines for the appeal process to be heard at the Superior Court of Justice.  If she loses this battle, she will have to wait another 10 years, until Dominic is 16 and can speak to the court for himself. In a recent conversation that Nicole had with Dominic, he said:

“Mama, I know I am coming home soon, so please work really hard and tell me what time I am supposed to start packing!”

  There are a few vital deadlines which are rapidly approaching. Nicole must meet these deadlines in order to have her final chance to be granted sole custody for bringing Dominic home. She must obtain all of the transcripts from her trial, which will cost her $4,712.00. She must have them in hand no later than April 21, 2015.   Furthermore, Nicole has exhausted all of her personal funds and has been denied any Legal Aid Ontario certificates for council or disbursements  and must raise approximately $3,600.00 in order to secure an attorney retainer fee to represent her in this final appeal. Her appeal must be perfected no later than May 11, 2015. If she fails to perfect her appeal by this time, her appeal will be deemed null and void.  Nicole has a modest income and has exhausted efforts to source any further funding options.  Being denied the crucial transcripts, is against her fundamental rights to natural justice.
