Dear CFBISD Families and Friends,
We’re a group of concerned parents from CFBISD who have filed a lawsuit against the school district and several trustees over the recent school closure decisions. We want to emphasize that it was HOW the closures were executed that needs the most reform.
After parents submitted public records requests, we found clear patterns of delay and denial from the district. In fact, one parent had to file a mandamus suit (a legal demand to release records) just to get basic information. What we did uncover points to serious violations of the Texas Open Meetings Act, which requires transparency in how school decisions are made, especially something as important as school closures. Discussions board members have about board decisions have to be done in an appropriately documented and advertised public meeting.
The Texas Supreme Court has amplified this point, declaring that Texas citizens “are entitled to more than a result. They are entitled not only to know what government decides but to observe how and why every decision is reached.” Acker v. Texas Water Comm’n, 790 S.W.2d 299, 300 (Tex. 1990).
We also included concerns about nepotism, the hiring of relatives, in clear violation of TEA (Texas Education Agency) policies, CFBISD board policies, and Texas nepotism prohibition laws by some trustees and the administration. These allegations are based on the documents we received from the district through our open records requests.
This isn’t about politics. It’s about protecting public trust and making sure the Trustees and central office administration, who are making big decisions for our campus administrators, teachers, staff, and especially our kids, are doing so with the full transparency required by the Texas Open Meetings Act.
We know many of you are still reeling from the closures and the way they were handled. We are, too. The problem is we see a pattern of bad behavior, and left unchecked, these patterns will continue to harm our kids and everyone working hard to support them, regardless of what school they attend. That’s why we feel we must act.
We know that many in our community want to move on and put this entirely behind us. We agree completely with that sentiment, but we cannot trust that these behaviors will cease without intervention. We want the community to have the information we need and have the right to have in a timely manner.
Again, this isn’t about Washington, D.C. or Austin. We understand they affect many things. It’s about our community and our district. We can and must do better.
